Damages You Can Claim
You can claim many types of damages for your whiplash injury so long as they’re directly related to it and the accident you were involved in.
Economic Damages
Economic damages refer to damages that have a set value attached to them. In other words, these damages usually get calculated based on your receipts, invoices, and other forms of financial documentation. There isn’t any need for additional work to see how much you can recover in your settlement.
Economic damages typically include:
- Lost wages
- Medical expenses
- Property damages
- Vehicle repairs and replacement
It is essential always to retain records of any expenses you’ve incurred. This makes it easier to prove them when it comes time to negotiate for your settlement.
Non-Economic Damages
These damages are the opposite of economic damages and have no fixed monetary value. Instead, our whiplash injury attorneys will calculate the value on your behalf and ensure that it gets reflected in your settlement correctly.
Non-economic damages usually consist of:
- Pain and suffering
- Emotional trauma and mental anguish
- Wrongful death
- Disfigurement and disability
- Loss of enjoyment of life
- Loss of consortium
We use various formulas to calculate your non-economic damages. In addition, we also take into account the context of your case, precedent, and multiple other factors. We want to see you get appropriately compensated for all of these damages at the maximum amount possible.
Statute of Limitations for Your Whiplash Injury Claim
You only have two years under the Official Code of Georgia Annotated (OCGA) §9-3-33 to file a claim to receive compensation after your whiplash injury accident. The law doesn’t give you a lot of time to get started. You must reach out to one of our attorneys today to begin building a strong case for your claim.
Allow our lawyers to help you win your settlement. You don’t have to face the insurance companies alone. Even the odds against them during negotiations by having solid legal counsel by your side. We will work hard to ensure that you don’t get the short end of the stick.
