How Motorcycle Accident Survivors in Suwanee Recover Maximum Compensation
Your John Foy motorcycle accident lawyer in Suwanee, GA is here to help you demand justice and recover the compensation you are entitled to when someone else is responsible for your crash. You are already dealing with the severe physical implications and emotional trauma of the motorcycle collision and should not have to figure out the justice system to be compensated.
You also should not be forced to deal with the financial losses on your own. Fortunately, there are multiple ways in which your motorcycle accident lawyer can fight for the compensation that is rightfully yours:
Insurance Claims
Filing a claim with the liable party’s insurance company will be one of the top ways you can recover compensation for your damages. Since Georgia follows a fault system for auto insurance purposes, instead of filing a claim with your own insurance, you will start by filing a claim with that of the at-fault parties.
However, if you purchased your own personal injury protection coverage or the liable driver is uninsured or underinsured, you may have the opportunity to file a claim with your own insurance company. Your motorcycle accident attorney in Suwanee, GA can advise you as to whether filing a claim with your own insurer is in your best interests. Doing so could increase your annual insurance premiums.
Civil Lawsuits
Bringing your case to trial may be in your best interests if an insurance settlement is not available or is not enough to cover your damages in full. Many victims do not realize that insurance only covers certain types of losses and that your settlement can be limited to the highest amount purchased by the policyholder.
This means some of your damages cannot be reimbursed through an insurance claim alone. In fact, one of the only ways to recover your non-economic damages is by filing a civil claim. Fortunately, your Suwannee motorcycle accident attorney will handle all of these legal details on your behalf. All you need to do is be prepared to pursue your opportunities across all potential avenues.
How Insurance Claims Work and What to Expect from Insurance Adjusters
Dealing with the insurance company is one of the most tiresome but essential elements of the motorcycle accident claims process. Unfortunately, bikers often find themselves stigmatized by insurance companies. They can capitalize on the “reckless biker” stereotype and attempt to argue that the victim in the case was reckless, irresponsible, or had no regard for their own safety or that of others on the roadways.
In doing so, the insurer may be able to get your settlement reduced under George’s modified comparative negligence laws. To avoid being taken advantage of by profit-hungry insurance adjusters, you must allow your attorney to step in and advocate for you. Your lawyer will negotiate with the insurance company to ensure they are being held accountable for their financial responsibility to your claim.
Even if the insurance company attempts to delay the processing of your claim, make a lowball settlement offer, or otherwise deny the settlement you are entitled to, your attorney will be by your side. They will work to assess liability accurately. They will compel the insurance company to compensate you based on the terms of the policy in question.
Statute of Limitations for Suwanee Motorcycle Accident Claims
Getting your motorcycle accident claim filed before the statute of limitations runs out is essential. Unfortunately, the clock starts ticking from the day the accident occurred in most cases. You will have a maximum of two years to get your claim filed according to Georgia personal injury laws.
However, the amount of time you have to file your claim could be shorter or longer if there are other factors in place. For instance, if you are filing an insurance claim, you might have only 30 days to get your claim filed with the insurer, giving you much less time to act. Or perhaps your minor child suffered injuries in a motorcycle accident. The statute of limitations might not begin running until that minor child reaches the age of 18, allowing more time to build a case.
These are just a few examples of how the statute of limitations may not always be clear. Since missing this deadline could have a disastrous impact on the outcome of your case, it is critical to get your motorcycle accident lawyer working on your case from the start. That way, your case will not be in jeopardy.

GA Motorcycle Helmet Laws
According to GA Code §40-6-315, all motorcyclists are required to wear a helmet when operating a motorcycle. Any motorcyclist who does not wear a motorcycle helmet may face penalties, including jail time and fines of up to $1,000.
Even with a helmet, you can suffer severe or debilitating injuries that could increase your need for compensation. Motorcycle accident cases frequently result in very high damage awards or settlements for their victims. However, each case is unique and your Suwanee motorcycle accident attorney will advise you on just what to expect in your claim.
