Motorcyclists Are Especially Vulnerable
Motorcycles are smaller than other vehicles on the road, which makes them less visible to other drivers and more susceptible to accidental hits. The National Highway Traffic Safety Administration (NHTSA) confirms motorcycle riders are “overrepresented in fatal traffic accidents.” For the most recent year of data collection, the NHTSA reports 5,579 deaths and estimates 82,528 injuries for motorcyclists involved in accidents.
In Georgia alone, there were nearly 4,000 motorcycle accidents for the most recent year of data collection, according to the Georgia Department of Driver Services (DDS), with 63% involving collisions with other vehicles.
When hit, motorcyclists do not have any layers of protection, other than the clothes on their backs and a helmet, to absorb impacts from other vehicles or with the road itself, increasing the potential for serious injuries and death. Such outcomes can bring drastic changes to your financial security, long-term health, and how you experience daily life.
What You Should Do After a Motorcycle Accident
If you are able, take photos or video of the accident scene and your injuries, collect contact information from witnesses, and exchange insurance information with the other parties involved. Ensure the authorities make an official accident report.
Your health comes first, though. Moving your body, especially after trauma to the head, neck, or back, can cause further injury. If that is your situation, do nothing until emergency services arrive.
Even if you do not think your injuries are severe, seek medical attention. The effects of some injuries, such as to the brain or internal organs, do not appear right away. If left untreated, they can lead to dangerous health problems.
What to Expect Following a Lithia Springs Motorcycle Accident
The days, weeks, and perhaps months following your accident will probably be spent getting medical care, adjusting to life with your injuries, and dealing with financial fallout. Medical care is expensive, and your injuries may leave you unable to work or care for yourself independently. These changes are painful physically, psychologically, and financially.
You or your representative, often a loved one, will have to communicate with insurance companies as you attempt to recoup at least some of your financial losses and hold the at-fault parties responsible. These communications are often frustrating and time-consuming, taking energy away from your recovery and leading to disappointing results.
However, with a Lithia Springs motorcycle accident lawyer from John Foy & Associates fighting for you, you have the chance to restore your financial security and be fairly compensated for your suffering, and you will not have to conduct any of those frustrating negotiations yourself.

How a Motorcycle Accident Lawyer in Lithia Springs Will Help You
A skilled motorcycle accident lawyer will save you time, ease your stress, and almost definitely bring you a higher settlement than if you manage your case on your own.
Value Your Case
Your experienced lawyer will consider the extent of your injuries, their short- and long-term effects on your finances, abilities, and quality of life, and the suffering you and your loved ones have endured because of your accident to determine the amount of a fair and just settlement.
This expert calculation is essential. In the chaos that follows an accident, it is almost impossible for victims or their loved ones to put a number on their needs. Sadly, insurance companies often capitalize on this confusion and offer inadequate settlements that desperate victims unfortunately accept.
Take Your Case Through the Legal Process
Secure legal representation as quickly as possible after your accident. Your Lithia Springs motorcycle accident attorney will ensure your injury claim is filed within Georgia’s two-year statute of limitations and will draw up and submit all legal documents properly and on time.
Your lawyer will handle all negotiations with insurance companies, at-fault parties and their representation, providing you with regular updates. If no adequate out-of-court settlement is forthcoming, your lawyer will advise you of your options. Should you take the case to court, your lawyer will provide representation in all proceedings.
Georgia Laws Can Affect Your Case
Georgia is an at-fault state, which means the party responsible for causing your injuries owes your compensation for those injuries. How much they owe you, though, is affected by Georgia’s modified comparative fault system.
Under this system, if you bear a level of fault for the accident and subsequent injuries, that fault can reduce the amount the at-fault party is required to pay you. For example, if you are found 30% at fault for the accident, the compensation the at-fault must pay is reduced by 30%. If you are more than 49% at fault, you are not entitled to any compensation.
Your motorcycle accident attorney in Lithia Springs will be vigilant, ensuring at-fault parties or their representatives do not get away with inflating your degree of fault, as they sometimes do to avoid paying out. Your motorcycle accident attorney in Lithia Springs will protect your interests so you receive the compensation you rightfully deserve.
You Need and Deserve a Fair Settlement
You will experience significant losses after a motorcycle accident. You may face:
- Property loss if your motorcycle was damaged or destroyed.
- Health and basic mobility loss if your injuries require long-term or permanent care.
- Career and income loss if your injuries prevent you from working in the capacity you did prior to the accident.
- Loss to your quality of life if you can no longer engage in social or recreational activities or care for your own needs.
- Emotional loss if you cannot share affection with your loved ones or suffer continued emotional trauma from the accident and its consequences.
A settlement can restore some of these losses, offering financial relief. Though a settlement cannot cure all injuries or emotional pain, it can bring a sense of justice and serve as an acknowledgment of your suffering. John Foy & Associates has a solid history of bringing that financial relief and justice to victims.
