What Makes a Hit and Run Case Different
A hit-and-run accident is different from a standard crash because the driver leaves the scene without sharing identification, insurance information, or helping injured people. That can make it harder to identify who caused the collision and where payment for your losses will come from.
Even when the other driver is unknown, you may still have legal options. Your own uninsured motorist coverage, medical payments coverage, or other insurance benefits may apply depending on the facts of the crash and the policy language.
These claims also move quickly. Video footage can disappear, witnesses can become hard to locate, and physical evidence may not last long, so hiring an experienced Decatur personal injury lawyer early can make a real difference.
How John Foy & Associates Investigates These Claims
A hit-and-run case often depends on building the facts from many small pieces of evidence. We work to identify the fleeing driver when possible and to document your damages, whether that driver is found or not.
Our work may include reviewing the police report, checking nearby businesses for surveillance footage, locating witnesses, inspecting vehicle damage, and working with accident reconstruction professionals when needed. We also review every available insurance policy to find coverage that may apply.
A car accident lawyer in Decatur from our firm can also handle insurer communications for you. That can help you avoid mistakes when an insurance company is looking for reasons to reduce or deny payment.
Insurance Issues in Decatur Hit and Run Accident Cases
Many people assume they cannot recover compensation unless the fleeing driver is identified. That is not always true.
Georgia drivers often turn to uninsured motorist coverage after a hit-and-run accident. In many cases, a fleeing driver is treated like an uninsured driver for claim purposes, which may allow you to seek payment for medical costs, lost income, and other losses under your own policy.
Why Uninsured Motorist Coverage Matters
This coverage can be a major source of recovery when the at-fault driver cannot be located. The amount available depends on your policy limits and whether there are other insurance layers that may apply.
Insurance companies do not always make this process easy. Even when you are claiming under your own policy, the insurer may still challenge fault, medical treatment, or the value of your losses, which is one reason many people speak with a Decatur car accident attorney early on.

Compensation You May Be Able to Recover
If someone else caused the crash, you may be able to seek damages for both financial and personal losses. The exact value of a claim depends on the injuries, available coverage, and how the accident has affected your life.
You may be able to recover compensation for:
- Medical bills and future treatment costs
- Lost wages and reduced earning ability
- Pain and suffering
- Property damage and vehicle repairs
- Emotional distress and mental anguish
If the hit and run resulted in a fatality, surviving family members may also have grounds for a wrongful death claim. We can explain how those claims work under Georgia law and what damages may be available.
Proving Fault When the Driver Leaves the Scene
You still need evidence showing how the crash happened and who caused it. Even if the driver is not identified at first, the facts may support your account and strengthen your insurance claim.
Useful evidence can include debris patterns, skid marks, witness statements, surveillance video, traffic camera footage, damage to your vehicle, and medical documentation. In some cases, paint transfer or parts left behind can help identify the make or model of the fleeing vehicle.
A Decatur car accident lawyer may also review whether another party shares blame. For example, if a commercial vehicle was involved, there may be company records, GPS data, or maintenance information that helps identify the vehicle and owner.
Time Limits Under Georgia Law
You do not have unlimited time to take action after a crash. Georgia law places a two-year filing deadline on most personal injury claims, and missing a filing deadline can bar recovery.
There can also be shorter notice requirements depending on the facts of the case, the insurance policy, or whether a government vehicle may have been involved. Waiting can also make it harder to gather evidence and locate witnesses.
Speaking with a hit and run accident attorney in Decatur soon after the collision can help you avoid preventable delays. Early review also gives you a better sense of what insurance coverage may be available.
