What Is Workers’ Compensation in South Carolina?
Workers’ compensation in South Carolina is an insurance program that provides benefits to employees who are injured or become ill due to work-related activities. Most employers with four or more employees must carry this insurance, and it covers most workers.
If you are hurt on the job, workers’ compensation can help cover your medical expenses and rehabilitation costs. In addition, you may receive wage replacement benefits equal to two-thirds of your average weekly wage, subject to a maximum amount set by the state.
If the injury results in a permanent disability, you may be entitled to additional long-term compensation. In cases where a worker dies as a result of a job-related injury or illness, their dependents or family members may be eligible to receive death benefits.
Do You Need an Attorney for a Workers’ Compensation Claim?
While you can file a workers’ compensation claim on your own, working with a workers’ compensation attorney means you can rest easy, knowing your claim is complete, includes necessary evidence and documentation, and is submitted on time.
Your employer may offer assistance, and their insurance provider may attempt to guide you through the process. Remember that they are offering advice based on what’s best for them. Hiring an attorney means you have an advocate on your side throughout the process.
Hiring our workers’ compensation attorneys in Newberry means you’ll have a better chance of a successful claim. However, if your claim is denied, our attorneys can help you with your appeal and represent you in legal proceedings.
What Should You Do if You Are Hurt at Work?

Report Your Injury
You have 30 days to report your injury, but you should make an official report to your supervisor or a designated person at your workplace as soon as possible. Make your report in writing and keep a copy, as well as copies of any other forms you are asked to fill out.
Consult an Attorney
Our Newberry workers’ compensation lawyers can assist you with your claim and ensure it is submitted properly. If you’ve been denied, we can help you with your appeal so you can receive the benefits you need for yourself and your family.
Seek Medical Treatment
It is important to see a doctor and follow their treatment plan. Your employer will provide a list of doctors who participate in the South Carolina workers’ compensation program. You can choose your doctor if you wish, but payments may not be covered.
Leave Communication to Your Attorneys
Our workers’ compensation attorneys in Newberry can handle the insurance company on your behalf. Simply refer them to your attorney when they call. We’ll manage communication, ensure they receive the necessary documents, and negotiate a settlement in certain cases.
Protect Your Information
You may want to inform your family and friends about your injury. However, it is important to avoid oversharing or making comments that downplay your medical situation. Insurance companies may use your words against you to deny your claim.
