Do You Really Need a Lawyer for a Car Accident Claim?

It’s tough handling a personal injury case on your own. You’re hurt, you’re under extreme stress, and unless you are a lawyer yourself, you probably don’t have a deep understanding of the law. It’s easy to make mistakes that can prevent you from recovering the full amount you deserve.

Even worse, many insurance companies will use every trick at their disposal to reduce or deny your payments. They may try to convince you to accept a settlement far lower than what you deserve or use your comments out of context to claim you aren’t as injured as you say.

You need an advocate with a proven track record who will stand up for your rights. You need The Strong Arm™. When you hire our car accident attorneys in Newberry, you level the playing field. We know how the insurance companies operate, and we know how to beat them.

Who Is Liable in a Car Accident?

South Carolina is an at-fault state, which means the person who caused the accident is liable for your damages. Often, that means another driver who collided with your vehicle. However, there may be cases where additional parties may have liability in your accident, such as:

• A third driver who contributed to the crash
• A pedestrian or cyclist who causes the other driver to swerve
• An employer, in cases involving commercial drivers
• A mechanic who allowed an unsafe car on the road
• A construction company that created unsafe lane alterations

Note also that South Carolina follows a modified comparative negligence system, which means you can recover damages even if you were partially responsible. However, your responsibility may not be greater than 50%.

How Much Is a Car Accident Case Worth?

The amount you can recover in a car accident claim depends on the extent of your damages. Your Newberry car accident lawyers will assess your hardships to maximize compensation on your behalf.

While every case is unique, some of the economic damages that may play a role in your compensation calculations include:

• Your medical expenses, including emergency care, procedures, doctor visits, and prescription medications
• Your long-term medical needs, like physical therapy, surgeries, and medications
• Lost wages to compensate for the income you missed when you couldn’t work
• Job retraining and vocational rehabilitation if you can’t return to your former occupation
• Costs for services you need while injured, such as childcare or housekeeping
• Property damage to repair your crashed vehicle

In some cases, you may also recover non-economic damages such as pain and suffering, mental anguish, or emotional distress. These are hard to prove, and your attorney can advise you if they may apply in your specific circumstances.

Do You Have to Sue After a Car Accident in South Carolina?

Most car accident cases in South Carolina are settled out of court. Our attorneys will negotiate with the insurance company on your behalf to reach a fair settlement that will cover your damages and help you get your life back on track.

Resolving your case through good-faith negotiations is usually faster, easier, and less stressful for accident victims. It works for insurance companies as well because they don’t need to spend money and time on a civil trial.

However, sometimes insurance companies like to do things the hard way. If they don’t respond to negotiations, we aren’t going to shy away from a fight. We’ll file a civil lawsuit on your behalf and let a court decide your award.
