Hampton Drunk Driving Accident Lawyer

Despite years of public awareness campaigns and harsh penalties for offenders, drunk driving has a heavy toll on Hampton and its environs. According to the latest Georgia Department of Transportation (GDOT) crash data, drunk drivers cause thousands of accidents per year statewide. Innocent drivers, passengers, and bystanders often suffer the brunt of the injuries and losses they inflict.

As the victim of a Hampton drunk driving accident, you likely have the legal right to receive financial compensation to help you pay for the expenses, challenges, and suffering you have been forced to endure. At John Foy & Associates, our award-winning team of car accident attorneys in Hampton helps crash victims like you obtain that compensation. You should not have to bear the burden of a drunk driver’s reckless actions on your own.

Who’s At-Fault for a Drunk Driving Accident?

After any Hampton motor vehicle accident, injured victims and families of deceased victims generally have the right to take legal action against the at-fault party (or parties) for money damages. By definition, drunk driving accidents happen because of a drunk driver’s illegal conduct. So, a drunk driver will almost always face legal liability to crash victims and their loved ones.

A Hampton drunk driving accident attorney can help you prove the other driver was at fault for your crash.

It’s Not Just the Drunk Driver Who May Owe Damages

But the at-fault drunk driver isn’t the only party who might owe you financial compensation as the victim of a Hampton-area crash. Under the so-called “dram shop” provisions of the Georgia Code, others may share liability for their injuries and losses with the drunk driver. Those parties can include:

• A bar, restaurant, liquor store, or other establishment licensed to sell alcohol that knowingly and willfully sold to a minor, knowing that the minor would soon be driving;
• A licensed establishment that knowingly and willfully sells alcohol to a person who was in a noticeable state of intoxication, knowing that person would soon be driving;
• A social host (i.e., someone other than a licensed seller, including a private party) who knowingly served alcohol to a minor individual or a noticeably intoxicated individual, knowing that individual would soon be driving

In other words, you should never assume that the drunk driver is the only party you may sue for damages after getting hurt in a Hampton drunk driving crash. It may even be possible for third parties—individuals and entities that had no role in the drunk driver’s intoxication—to owe damages for the harm you suffered in a drunk driving crash. They could include, for example, other (non-intoxicated) drivers, automotive manufacturers, or municipal agencies.

At John Foy & Associates, we investigate the details of drunk driving crashes to identify every party who may serve as a source of financial compensation for our clients. We aim to maximize the chance of getting you every dollar you need to pay for your injuries and losses.

Potential Damages for a Hampton Drunk Driving Accident

Every victim of a drunk driving accident in Hampton suffers unique and highly personal injuries. The John Foy & Associates team gives the drunk driving accident victims we represent individualized attention. There is no such thing as a “cookie-cutter” case for us—every client receives legal services tailored to their needs and priorities.

Over more than 20 years, we have achieved results totaling more than $1 billion in financial compensation to our clients. Although we cannot guarantee the outcomes of the cases we take, by taking legal action against parties at-fault for a drunk driving accident, we can often secure payment for:

• Medical expenses for treating your drunk driving accident injuries and long-term health complications
• Other expenses resulting from the accident and the injuries it inflicted on you
• Wages and employment benefits you lost when you took time away from work to heal
• Future income you will not earn because of the impact of your injuries
• Your physical pain, emotional suffering, and diminished quality of life due to your injuries
• In the event of a fatal drunk driving accident in Hudson, wrongful death damages to the victim’s surviving spouse or family members

Because drunk driving is inexcusably reckless and preventable, we can sometimes convince a Henry County court to direct the at-fault party to pay punitive damages to our injured client or the victim’s grieving family.

You Have Rights Even if the Drunk Driver Faces Criminal Charges

The Henry County District Attorney may file criminal charges against the drunk driver who caused the Hampton accident that injured you or your loved one. However, do not confuse that potential prosecution with your right to sue for money damages after a Hampton drunk driving accident. A lawsuit or insurance claim you file seeking financial compensation is separate from any action the District Attorney pursues.

Likewise, your rights to compensation do not depend on the punishment the drunk driver faces. Even if the drunk driver ends up with a lengthy jail sentence, you can still likely pursue payment from the driver’s auto liability policy, the driver’s assets, and any other party who has legal liability under Georgia law for the harm you suffered.
