How Much Money You Can Recover After Being Hit by a Drunk Driver
After a crash with a drunk driver, there is no one set price tag on your damages. How do you put a dollar amount on the suffering you’ve experienced and the tolls your accident has put on your life?
The truth is that an experienced DUI accident attorney can do just that. Your lawyer can calculate your damages to show how much you’re owed by the at-fault party. That doesn’t just include the bills you’ve had to pay—it’s also non-economic damages, including pain, suffering, and mental stress.
That’s how much you can get from your drunk driving accident claim: compensation that covers the full scope of your damages and allows you to get back on your feet while holding the other driver accountable. Damages that you can claim in a DUI accident case include:
- Medical bills
- Car repairs
- Lost wages
- Diminished earning potential
- Pain and suffering
- Mental anguish
- Funeral expenses in the event of a wrongful death
As for the specific amount of money you’re eligible for, that all depends on your situation. No two accidents are the same, and everyone has different needs during their recovery process. To find out how much compensation you can get, you can talk to one of our lawyers for free.
DUI Accident Lawyers in Woodstock
When you’ve been affected by a drunk driver, whether you yourself were in a crash or if your loved one died because of someone driving under the influence, a drunk driving accident lawyer in Woodstock, GA, can help. By helping you with your case from beginning to end, your attorney can get you the compensation you deserve.
A DUI accident lawyer can:
- Investigate your case
- Gather evidence of the other party’s negligence
- Calculate your damages
- Negotiate with the insurance company
- Represent you in court in the rare instance that the other side won’t settle
The first thing your lawyer will do for you is to listen. At your no-fee, no-obligation initial consultation, your attorney will hear you out and talk to you about your situation. Once they have a good idea of what you’re up against, they’ll tell you how they can help and how much you can expect from your settlement.
On top of all that, our lawyers don’t take anything up front. We take contingency fees, which means we only get paid if you get compensation. That way, you don’t take on any risk of paying for an attorney who won’t get you results.
Negligence in Drunk Driving Accidents
For many car accident claims, there is a bit of difficulty in proving that the other driver was at fault. That isn’t the case with DUI accidents, as it’s easy to show that the drunk driver was responsible for your damages. In fact, in certain cases, that could be all a victim needs to show to get compensation.
However, there are still factors that could complicate your case. One of those factors is Georgia’s dram shop law, filed under the Official Code of Georgia Annotated (OCGA) § 51-1-40. This law states that any vendor or server who serves alcohol to someone who is visibly intoxicated or underage knowing that they will drive soon could also be liable.
This means there could be a third party involved in your DUI accident claim. While this makes the case a bit more complicated, it also means there could be more compensation available. Your Woodstock drunk driving accident attorney can investigate your crash and make sure all responsible parties are held accountable.

Can I Still Get Compensation if the Drunk Driver Wasn’t Charged?
Yes, if you were hit by a drunk driver who wasn’t charged, you could still collect compensation. Drivers acquitted of their DUI can still be held accountable for an accident, but their acquittal does make your lawyer’s job harder. You can still file your lawsuit and collect compensation, though.
When the other driver beats their DUI charges, they could still be held liable for your damages. As long as they were negligent and their negligence was to blame for your accident and the hardship that came after, you can pursue compensation. An acquittal just means your attorney has to find other evidence that proves your claim.
