You can sue Tesla for an autopilot crash if the accident was caused by Tesla’s negligence or a defective autopilot system. That said, even if you are eligible to take legal action against Tesla, it doesn’t mean that you’ll get the damages you’re owed. You’ll need to hire a skilled Atlanta Tesla accident lawyer to get the compensation you deserve.
An experienced lawyer can investigate your accident, gather valuable evidence, and file a strong lawsuit on your behalf. With their help, you’ll have an excellent chance at getting the damages you need to cover medical bills and get back on your feet. Let’s take a closer look at when you can sue Tesla for an autopilot crash and how a lawyer can help you.
When You Can Sue Tesla for an Autopilot Crash
As mentioned above, you can sue Tesla for an autopilot crash if an autopilot system defect or Tesla’s negligence caused the incident. It’s important to note that Tesla doesn’t market its autopilot feature as a full self-driving assistant. Instead, it’s sold as a safety enhancement. In addition, drivers are instructed to keep their hands on the wheel when using autopilot.
If your hands weren’t on the wheel at the time of the incident, you may have trouble taking legal action against the electric vehicle company. That said, the legal framework for Tesla autopilot lawsuits is still developing, so you’ll want to speak with an attorney even if you’re unsure if you have grounds for a claim.
Examples of Tesla Autopilot Crash Cases
If you’re unsure whether you’re eligible to sue Tesla for an autopilot crash, it can be helpful to review examples of Tesla lawsuits. In addition to speaking with a knowledgeable attorney, familiarizing yourself with the following types of cases can help you determine if filing a civil suit against the electric vehicle company is the right choice for you:
Product Defect or Malfunction
Tesla’s Autopilot system includes a mix of sensors, software, and algorithms. If any part of that system fails due to a design flaw, poor manufacturing, or inadequate testing, it could be considered a defect. If your accident was caused by an autopilot system defect, Tesla could be held liable for your medical bills, vehicle repair costs, and other losses.
Autopilot Misuse Due to Tesla’s Messaging
Although Tesla states that autopilot is not a fully self-driving system, some critics argue that the name itself, along with promotional materials, can give drivers the wrong impression about the feature. If you relied too heavily on the system due to misleading instructions or marketing, Tesla may be held responsible for your collision.
It’s important to note that every Autopilot crash is different. A skilled attorney must investigate your accident to determine whether the system failed, the autopilot was misused, or Tesla failed to provide adequate safety warnings and instructions. If an attorney finds that Tesla’s negligence or an autopilot defect caused the accident, you may be able to sue Tesla for the autopilot crash.
