How to Get Justice After a Drunk Driving Accident in Villa Rica
Following a collision with a drunk driver, you may be anxious and worried about how your life will be affected. Your drunk driving accident lawyer in Villa Rica, GA is here to help you get justice.
There are multiple ways in which your attorney may be able to seek the compensation and benefits you are entitled to when a drunk driver causes your injuries. These options could include:
- Filing a claim with your own insurance company if you purchased no-fault or personal injury protection (PIP) coverage
- Filing a claim with the at-fault driver’s auto insurance provider if they carried auto insurance coverage
- Filing a civil lawsuit against the drunk driver
In many cases, drunk driving accident claims will need to be filed both with the insurance company and in court if victims hope to get the justice they seek. Unfortunately, many insurance companies will fight back when you file a claim against a drunk driver.
Additionally, insurance settlements, when they are paid, do not adequately cover the victim’s damages. You have the right to be repaid for every loss, not just the types of coverage included in the liable party’s auto insurance policy. Allowing John Foy & Associates to negotiate with the insurance company and bring your case to court may be the best way to set your drunk driving accident case up for success.
Liability for Villa Rica Drunk Driving Accidents
Your drunk driving accident attorney in Villa Rica, GA will be tasked with figuring out who is responsible for causing your collision. In accidents involving drunk drivers, the vast majority of victims are ready to go after the drunk driver for their negligence. While drunk drivers are the primary cause of the accident in many cases, you might be surprised to learn that other parties can be held accountable when impaired driving is the cause of your accident.
Georgia has dram shop liability laws governing overserving at any establishment that serves or sells alcohol. If the dram shop supplies alcohol to someone who is already intoxicated, the establishment can be held accountable if that person goes on to cause a collision.
Additionally, according to Georgia’s social host liability laws, social hosts can be held accountable when intoxicated guests later cause motor vehicle accidents. This is often seen in instances where adults provide alcohol to minors who leave the party and cause underage drunk driving accidents. An in-depth review of the circumstances of your drunk driving accident claim will reveal which party should be held accountable for your damages.
