Eligibility Rules for Social Security Disability Benefits
To qualify for disability benefits, you must have a medical condition that stops you from working and is expected to last at least 12 months or result in death.
The Social Security Administration (SSA) uses a five-step review process that looks at whether you are working, how serious your condition is, your medical records, your past jobs, and whether you could do any other kind of work.
There are two main programs. Social Security Disability Insurance (SSDI) is for people who have worked and paid into Social Security long enough to qualify. Supplemental Security Income (SSI) is for people with limited income and resources, regardless of work history. In some cases, you may qualify for both at the same time. This is called a concurrent claim.
What Our Gresham Park Social Security Disability Lawyers Do for Claimants
Working with a social security disability lawyer in Gresham Park can help you avoid mistakes that slow down or hurt your claim. We focus on building strong evidence, staying on top of SSA deadlines, and presenting your case in a clear and convincing way.
Here is what we handle for you:
- Prepare and file your SSDI or SSI application correctly
- Gather your medical records and supportive statements from your doctors
- Track deadlines and respond to SSA requests on your behalf
- Prepare you for medical exams and hearings
- Present legal arguments and question job experts at your hearing
From the first form to your final hearing, we handle the details so your case tells a clear and consistent story.
Avoiding Common Claim Denials
Most early denials come down to a few common problems: not enough medical records, earning too much money, or submitting incomplete forms. Missing a required medical exam or failing to respond to a hearing notice can also lead to a denial or get your case dismissed entirely.
A Gresham Park social security disability lawyer can help you stay on track and avoid these pitfalls. You can also help your case by keeping up with medical treatment, following your doctor’s recommendations, and letting the SSA know right away if your address changes.
If you can’t afford care, ask your doctor about low-cost clinics or payment plans based on your income. Keeping consistent records is one of the most important things you can do.

Distance is no obstacle. We work with clients across the country and make sure every one of them feels taken care of, no matter how far the call travels.
Appeals: What Happens if You Are Denied
If your claim is denied, you generally have 60 days to appeal. The first step is called reconsideration, where a different SSA reviewer takes a fresh look at your file. If you are denied again, you can request a hearing before an Administrative Law Judge (ALJ), where you can share testimony and present new evidence.
Hearings are often held in Atlanta and can take place in person, by video, or by phone. A job expert may also testify at your hearing about what kinds of work you could or could not do. After the hearing, you will receive a written decision. If needed, you can take your case to the Appeals Council or federal court for further review.
Fees and Costs: What You Need to Know
At John Foy & Associates, our fees are contingency-based, meaning you pay nothing unless we win benefits for you. If we win, the SSA reviews and approves the fee, which is typically a percentage of your back pay up to a limit set by federal law. Your ongoing monthly benefits are always yours to keep.
Costs for things like obtaining medical records or filing fees are separate from attorney fees. We walk you through all expected costs at the start, keep you updated as your case moves forward, and will always ask for your approval before any unusual expense.
