Why Choose Our Gresham Park Truck Accident Lawyer?
Local knowledge matters. Crashes near I-20, I-285, Candler Road, and Flat Shoals Road often involve heavy traffic, confusing merges, and commercial routes. Our attorneys know how carriers and their insurers handle claims in DeKalb County.
We move quickly to secure evidence truck companies control, like electronic logging device (ELD) data and driver qualification files. From day one, our team positions your case so the insurer takes it seriously, whether we resolve it through settlement or file suit.
What to Do Immediately After a Crash
Your health and safety come first. The steps you take in the first hours can also protect your claim and help your attorney move faster later.
- Call 911 and request medical care, even if symptoms seem minor
- Photograph vehicles, cargo, skid marks, and road conditions
- Get witness names, phone numbers, and email addresses
- Avoid discussing fault at the scene or on social media
- Seek a prompt medical evaluation and follow the doctor’s orders
Damages You Can Recover Under Georgia Law
A truck crash often brings more than vehicle repairs. Under Georgia law, you may recover medical bills, future treatment costs, rehabilitation, and medication expenses. If your injuries keep you from working, you can claim lost wages and diminished earning capacity.
You may also pursue compensation for pain and suffering, anxiety, PTSD, and loss of enjoyment of life. Property damage, rental car expenses, and out-of-pocket costs are part of a claim. In fatal crashes, eligible family members can bring a wrongful death action for the full value of the life of the decedent and related losses.
Atlanta Roots, Nationwide Reach.
Distance is no obstacle. We work with clients across the country and make sure every one of them feels taken care of, no matter how far the call travels.
How Liability Works in Commercial Vehicle Cases
Truck cases are complicated because multiple parties may share fault. The driver, motor carrier, broker, shipper, maintenance contractor, or parts manufacturer could be responsible. Under Georgia law and federal motor carrier rules, a carrier can be liable for its driver’s negligence and its own unsafe practices.
We look for hours-of-service violations, overweight loads, improper securement, negligent hiring, and poor maintenance. Early preservation letters help prevent the destruction of critical records such as driver logs, ELD data, dispatch notes, and inspection reports. Holding each responsible party accountable can increase available insurance coverage.
Evidence That Strengthens Your Claim
Strong evidence moves cases. Police crash reports, bodycam video, scene photos, and nearby business surveillance can explain how the impact occurred. Independent witnesses add neutral support when stories conflict.
Medical records connect your injuries to the crash and document the pain you carry daily. We often retain accident reconstructionists, biomechanical experts, and vocational economists to present your case in a clear, fact-based way that insurers and juries respect.
Dealing With Insurers Without Losing Ground
Insurers handle truck claims with teams of adjusters and defense lawyers. You may face quick calls asking for recorded statements or fast, low offers that don’t cover future care. Politely refer all calls to your attorney and avoid signing broad medical releases.
As truck accident attorneys in Gresham Park, we manage adjusters, set the claim value with medical and wage documentation, and push for a result that reflects your losses. If the carrier drags its feet or disputes fault, we file suit and continue building leverage.
How Truck Accident Claims Work in Gresham Park
Most cases start with an investigation and a formal claim against all potential defendants. After your medical condition stabilizes, we submit a detailed demand package with evidence, legal arguments, and a settlement proposal. Many cases resolve here, but not all.
If talks stall, we file in the proper venue, often the State Court or the Superior Court of DeKalb County. Litigation includes written discovery, depositions, expert work, and mediation. We keep you updated, explain choices at each stage, and move your case toward trial or a fair settlement.
Deadlines and Filing Timelines in Georgia
Georgia generally gives you two years from the crash to file a personal injury lawsuit and four years for property damage. Shorter deadlines can apply when a government entity is involved, sometimes as little as six months for ante litem notices. Missing a deadline can end your claim.
Evidence can fade fast. Trucking companies cycle data, drivers change jobs, and road conditions change within days. Contacting a truck accident lawyer early helps lock down proof while it’s still available.
What We Do for You From Start to Finish
We start with a free case review to learn what happened and explain your options. Then we launch a targeted investigation, from ECM downloads to witness interviews, and coordinate your records so your damage picture is complete.
We help track medical bills, address health insurance and liens, and evaluate future care needs. When talks begin, we negotiate from documented facts. If the insurer won’t agree to a fair number, we’re ready to litigate and present your case to a jury.
Cost, Fees, and Our No-Win, No-Fee Promise
Hiring John Foy & Associates costs nothing upfront. We work on a contingency fee, which means our fee comes from the recovery, and only if we win money for you. This aligns our interests with yours.
We advance case costs, such as filing fees and expert expenses, and explain how those are handled at the end of the case. You can focus on healing while we handle the legal and insurance work.
