Immediate Steps to Protect Your Health and Claim
Get medical care right away, even if symptoms seem minor. Concussions, internal injuries, and whiplash often show up hours or days later. Calling 911 also creates a record that anchors your claim.
Ask police for the report number, and gather photos, witness names, and the other driver’s insurance details if you can do so safely. Avoid posting about the crash on social media, and keep all bills, receipts, and out-of-pocket records.
If an insurer calls, do not give a recorded statement or accept a fast payment. Those early offers rarely reflect the full value of a DUI crash case in Georgia.
How a DUI Accident Lawyer in Gresham Park Builds Your Claim
Our Gresham Park personal injury lawyer gathers police reports, body-cam footage, DUI test results, and witness statements to show impairment and fault. We also secure crash reconstruction and, when needed, subpoenas for bar tabs, surveillance, or rideshare data.
Next, we connect your injuries to the collision with medical records and physician opinions. We document wage loss, future care needs, and the daily impact of pain and limitations. This documentation helps us present a demand that reflects your full damages.
If the insurer refuses to be fair, we file suit in the proper DeKalb County court and prepare your case for trial. A strong litigation posture often moves adjusters to negotiate seriously.
Proving Fault and Intoxication
Evidence of intoxication strengthens civil liability and puts pressure on insurers to pay fairly. Useful sources include the officer’s observations, field sobriety results, breath or blood tests, and any admissions captured on video or by witnesses.
We also look for bar receipts, service policies, or prior incidents that show a history of risky choices. In hit-and-run or uninsured scenarios, we use traffic camera footage, vehicle data, and your UM/UIM coverage to keep your claim moving forward.
How Breath and Blood Tests Influence Civil Liability
Breath and blood results can help establish negligence by showing a statutory DUI violation. Even if attorneys challenge test results in the criminal case, they may still be admissible in civil court with a proper foundation. We track lab handling, certification, and chain of custody to prepare for any defense arguments.

Distance is no obstacle. We work with clients across the country and make sure every one of them feels taken care of, no matter how far the call travels.
Compensation You Can Pursue Beyond the Criminal Case
The criminal process punishes the driver; it does not pay your bills. Your civil claim seeks money for the losses the crash created. Depending on the facts, you may pursue money to pay for:
- Medical bills and future treatment
- Lost wages and reduced earning capacity
- Pain, suffering, and loss of enjoyment of life
- Vehicle repair or total loss
- Punitive damages in DUI cases
- Wrongful death and funeral costs for families
For severe injuries, we build life-care plans and retain experts to outline long-term costs. That documentation helps us present a clear picture to the insurer or jury.
Timelines and Deadlines Under Georgia Law
You must file most Georgia injury claims within two years of the crash date. Property damage claims generally have a four-year deadline. Wrongful death is also typically two years, but unique rules apply to estates.
What To Expect When We Handle Your Case
We start with a free consultation to learn your story and identify your next steps. If we work together, we move quickly to secure evidence, contact insurers, and coordinate your medical documentation.
You’ll receive regular updates and prompt answers to your questions. We prepare every claim as if it may go to trial, which often leads to stronger settlements. If trial is the best route, we’re ready.
Our fee is contingency-based. You pay nothing up front, and we only receive money for legal fees if we recover money for you. That way, you can focus on healing while we handle the legal work.
How Local Knowledge Helps Your DUI Case
Cases in Gresham Park typically run through DeKalb County courts. Familiarity with local procedures, judges, and jury trends helps us plan your case strategy and timelines.
We often work with nearby medical specialists and reconstruction experts who can testify clearly and persuasively. That local network can make a difference in contested liability and damages.
When needed, we coordinate with prosecutors to secure certified records, including convictions or guilty pleas, which can streamline proof issues in your civil claim.
