What Makes Drunk Driving Crashes Different
A drunk driving wreck is more than a standard traffic accident. When a driver chooses to get behind the wheel while impaired, that choice can shape both the insurance claim and any lawsuit that follows.
In many cases, the police investigation may include field sobriety testing, chemical test results, witness statements, and criminal charges. That information can help show fault, but a criminal case does not automatically pay your losses.
Your civil claim is about what the crash cost you. We work to connect the impaired driver’s conduct to your injuries and the financial harm you now face.
How a DUI Accident Claim May Be Proven
To recover compensation, you usually need to show that the other driver caused the collision and that you suffered measurable harm. In a DUI accident case, proof may include both general crash evidence and signs of impairment.
Evidence may include:
- Police reports and arrest records.
- Breath, blood, or urine test results.
- Photos of vehicle damage and the scene.
- Medical records and treatment notes.
- Witness statements about erratic driving.
Even if the other driver was not convicted, you may still have a valid injury claim. The legal standard in a civil case is different from the standard used in criminal court.
Compensation You May Be Able to Recover
A claim after a drunk driving crash can include more than the first emergency room bill. You may have the right to pursue payment for both current losses and future costs tied to your injuries.
Common damages in these cases include:
- Medical expenses and future treatment costs.
- Lost wages and reduced earning ability.
- Vehicle repair or replacement losses.
- Physical pain and emotional suffering.
- Wrongful death damages for surviving family members.
Some cases may also involve punitive damages. These damages are meant to punish especially dangerous conduct, and drunk driving may support that type of claim in the right situation.

Steps to Take After a DUI Accident in Rockmart
What you do after the crash can affect your case. If you are physically able, taking a few practical steps may help protect both your health and your claim.
Get medical care as soon as possible and follow your doctor’s instructions. Keep copies of bills, discharge papers, repair estimates, prescription costs, and any records showing missed time from work.
Try not to discuss fault with the insurance company before you know your rights. A Rockmart DUI accident attorney can help you avoid mistakes that may weaken your case.
DUI Accident Cases and Deadlines in Rockmart
Georgia law limits how long you have to file most personal injury lawsuits—typically, that is two years from the date of the crash. If you wait too long, you may lose the chance to pursue compensation in court, even if the drunk driver clearly caused the wreck.
There can also be deadlines tied to preserving evidence and dealing with insurers. Skid marks fade, surveillance footage can be erased, and witnesses may forget details as time passes.
Acting early gives your legal team more time to collect proof and evaluate the full value of your losses. A personal injury lawyer in Rockmart can explain how the timing rules apply to your case.
When a Bar or Restaurant May Also Be Liable
Some DUI accident claims involve more than the impaired driver. In limited situations, a business that served alcohol may share liability under Georgia dram shop rules.
These claims usually depend on specific facts, such as whether alcohol was served to a noticeably intoxicated person or someone underage who was likely to drive. These cases are fact-based and often require careful investigation.
If another party contributed to what happened, bringing them into the claim may increase the insurance coverage available. That can matter when injuries are severe, and the driver’s policy is not enough.
