Five Ways You Can Build a Strong H&M Slip and Fall Accident Claim in Georgia

If you slipped, fell, and were hurt in an H&M store in Georgia, you likely have a case. All property owners have a legal duty to those who come onto their premises. They must maintain a safe place and act in a way that prevents harm.

If a visitor or customer is hurt because the store was careless or negligent, the store is responsible for the costs (Georgia Code § 51-3-1). However, it’s never that easy. You, as the injury victim, will need to file a claim for compensation. To do that, you will need to build a strong case in the following ways.

Take Pictures of the Scene and Your Injuries

This is an easy thing you can do immediately after the accident happens. Pull out your phone and snap some pictures of the scene and any visible injuries you have. Make sure you get clear images of what caused your accident.

After you’ve left the scene, be sure to take pictures of any changes in your injuries, too. If they change in appearance or worsen, document it for your insurance claim.

Report the Accident

Make sure you tell the store about your accident. Ask to speak to a manager and tell them that you fell and were injured. Stick with the facts only, and do not admit any blame or apologize. Remember that anything you say may be used against you later.

Get the Contact Information of Witnesses

Was anyone else around when you fell? Did they see what happened or what caused you to fall? Get their contact information because their testimony may be very powerful for your case.

Document All of Your Medical Costs

Medical expenses typically make up the largest part of a slip and fall accident claim. However, you will need to be able to prove all your medical costs. To do this, you should keep track of all bills, receipts, and invoices related to your accident expenses.

If your injuries are expected to need long-term treatment or you are left with a disability, talk to your doctor and your slip and fall accident lawyer about the details. You deserve compensation for all current and future costs from an accident you didn’t cause.

Communicate Often With Your Slip and Fall Accident Lawyer

A trusted and experienced attorney should be one of your first calls after your accident. Your lawyer can help you with:

• The process of writing a demand letter
• Gathering evidence for your case
• Building a strong injury claim
• And communicating with the insurance company on your behalf

You will need to schedule a consultation so your lawyer can properly advise you on the best course of action for your case. Thankfully, most personal injury lawyers, like John Foy & Associates, offer the consultation free of charge. To schedule a consultation with us today, call (404) 400-4000.

Why You Should Talk to an H&M Slip and Fall Accident Lawyer as Soon as Possible

Before discussing anything further with the H&M store or the insurance company, contact a slip and fall lawyer in your area. Even if you clearly have a case, it doesn’t mean you will be able to easily resolve it and go home with your money.

The store and its insurance company know what they are doing. They may try to get information from you that can be used to fight your case. Insurance companies are looking to pay as little as possible on accident claims because it maximizes their shareholders’ profit.

When you have an attorney on your side, it levels the playing field. Your claim is more likely to be taken seriously if you are working with an attorney. The insurance company will know that you have someone on your team who understands the law and can litigate on your behalf.

You Probably Will Not Have to Sue H&M, But You Can

Most injury claims are settled outside of court, but you will not likely get a fair offer without hiring a lawyer. First, you’ll probably receive a lowball settlement offer that doesn’t come close to covering the full extent of your damages.

With a lawyer, you can negotiate for a settlement that is actually fair. In most cases, an agreement is reached that helps cover your costs. However, if the insurance company refuses to negotiate a number that is fair to you, even with a lawyer on your side, you have the right to sue H&M for compensation.

If you do end up taking the store to court, your attorney will help you prepare and be there every step of the way.
