What to Know About Forever 21 Stores in Georgia
Forever 21 is a “fast fashion” store headquartered in Los Angeles, California. They were originally called Fashion 21 before transitioning to Forever 21 and expanding into several clothing lines in 1984. There are many Forever 21 stores throughout different Georgia cities, including Atlanta, Fayetteville, Alpharetta, and Savannah.
Forever 21 began selling clothing specifically for women, but they have since included menswear in their merchandise offerings. Store layouts can include confusing sections and messy racks, which can be hard to navigate and expose customers to potential slip and fall accident hazards.
How to Know If You Have a Winning Forever 21 Slip and Fall Case
Georgia law states that property owners have a duty to those who come onto their property. They must maintain safe premises for visitors and customers. If they fail to do so and it results in an injury, they are liable for the damages.
As a slip and fall accident victim, you may have a winning case if:
- Your accident directly resulted from the store (namely, its employees) being negligent
- You were injured during the slip and fall accident
- The damages you are claiming for compensation directly resulted from the accident
In Georgia, when you are injured at the fault of a store like Forever 21, you have a legal right to make a claim for compensation in damages (Georgia Code §51-12-4). However, hiring an experienced Forever 21 slip and fall lawyer is highly recommended to pursue a winning case. They can ensure your rights are protected and the store, or their insurance company, do not take advantage of you.
To know for sure if you have a winning slip and fall accident case, schedule a consultation with an attorney who understands these types of cases. At John Foy & Associates, the consultation is always FREE. To discuss your case and your options today, call (404) 400-4000 or contact us online.
Never Accept the First Compensation Offer
Stores like Forever 21 have a team of insurance adjusters ready to take on slip and fall injury claims from customers who are hurt on their premises. Even if they are completely at fault, they will look for ways to reduce their liability and what they pay you. They will try to shirk their responsibility for damages from your accident like:
- Ambulance rides (if you needed emergency medical care)
- Hospital and doctor bills
- Lost wages from missed work time because of your injury
- Any ongoing medical costs, such as for physical therapy
- Pain and suffering damages like loss of enjoyment of life
A very common tactic insurance companies use is offering you a lowball settlement upfront. They are hoping you’ll take this offer out of desperation to pay for your immediate bills. However, this settlement offer is rarely even close to what you need to recover all your costs.
Having a lawyer levels the playing field. It increases the chances of the store (and their insurance company) taking you seriously and offering a settlement that is fair. Your attorney can communicate and negotiate with the insurer on your behalf. They can also ensure any actions you take from here on are protecting your rights as an injury victim.
