What Should I Do If I Fall and Get Injured?
After slipping and falling, you might feel hurt and confused—and many victims immediately start blaming themselves. But don’t let yourself or anyone else try to tell you the slip and fall accident was your fault. More often than not, you have a case.
Chances are, your fall happened because some unsafe condition was in place like a hazard or obstacle. A person or business in charge of making the situation safe is legally responsible if you fall on their property. Therefore, there are some things you can do after a slip and fall to help demonstrate the problem that led to your accident.
Get Immediate Medical Attention, If Necessary
If your slip and fall injuries are bad enough to require immediate medical treatment, please don’t hesitate to call 911 and get help. Your well-being comes first. That being said, if you are able to stay at the scene, spend time gathering information about the accident.
Take Pictures and Videos
Use your phone to take pictures of the slip and fall scene, including the hazard or obstacle that led to your fall. For example; the hazard could be a wet floor at a grocery store where the manager failed to leave out a sign or some crooked stairs in a building without any warning signs.
Take plenty of pictures, even video if you feel it will help. After a slip and fall, it’s easy for a property owner to quickly clear away a hazard, so photo evidence will show it was actually present when you fell.
Also, take pictures of your injuries—right after the fall and in the hours and days afterward, especially if your injuries worsen with time.
Tell Someone
If your accident happened at a place of business, tell the manager or owner about it. Ask for the person in charge and mention that you were injured. If that person isn’t present on the property at the time, get their name and contact information, and leave your own information so they can get in touch with you.
Talk to Witnesses
If you fell in a public place, it’s likely other people saw what happened. Even if they didn’t see the actual fall, they could have noticed the hazard that caused it. Ask them what they saw and gather their contact information. Their testimony can be powerful for proving the accident in your case.
See a Doctor
If you didn’t seek medical attention right away, definitely see a doctor as soon as possible after the above steps. The doctor can give you a full checkup and diagnosis. This will create a record of your injuries and also allow you to start treatment right away. And if your injuries worsen with time (which is common for slip and fall injuries), let your doctor know and see them for any additional problems.
Insurance companies often try to claim slip and fall victims are exaggerating their injuries, so going to the doctor will demonstrate that your injury was serious from the beginning.
What If I Was Drunk When I Fell – do I Still Have a Claim?
Slip and fall accidents that happen while intoxicated are common at places like clubs or concerts. The fact that you were drunk could affect how much you can recover in your claim, depending on the specifics of the situation. However, if the property had an obstacle or hazard that they didn’t take care of, and you fell because of it, they are responsible and you could still have a valid claim against them.
It’s best to consult a slip and fall lawyer in this situation. They can look at all the facts and determine your best course of action.
Will I Have to Sue Anyone?
Most of the time with slip and fall claims, things can be resolved without ever having to step foot in a courtroom. Having a good lawyer will especially help you come to a fair settlement. If the insurance company for some reason won’t budge in your negotiations, it is always possible to sue for a slip and fall. However, it’s not common in most situations.
