Title 42 §3796b of the U.S. Code states that a catastrophic injury is one that prevents a person from doing any gainful work. In other words, if you were in an accident that resulted in you no longer being able to work, by law, you suffered a catastrophic injury.

What Can Your Catastrophic Injury Lawyers Do for Me?
When you hire one of our catastrophic injury lawyers in Acworth to help you, you get more than just essential legal services. We dedicate ourselves completely to your case and provide you with many benefits.
Gather and Organize Evidence
Evidence is critical when it comes to proving your damages in court or during negotiations. If you don’t have any evidence to support your claim, you won’t be able to win against the insurance company for a settlement.
Our lawyers will gather essential evidence such as police reports, medical records, and witness testimonies to ensure that your case has strong material supporting it. Then, when we negotiate for a settlement, we will use all of the evidence we’ve organized on your behalf.
Consult with Experts
There are experts in various fields in medicine and accident reconstruction that can provide supporting testimony to your claim. Our lawyers can add legitimacy to your claim by consulting with experts and ensuring that the insurance company can’t lie or weasel their way out of paying you fair compensation.
Allow You to Heal
Our lawyers allow you to heal and recover as much as you can from your catastrophic injury. We do this by letting you focus on what matters the most, your health. So instead of dividing your attention between a legal battle and your wellbeing, let us handle all of the work for you.
What Are Damages that I Can Be Compensated for?
You can recover compensation for both economic and non-economic damages. As long as your damages resulted from your injury, we will factor them into your settlement.
Economic Damages
Economic damages usually consist of:
- Lost wages
- Property damages
- Vehicle repairs or replacement
- Medical expenses
These damages typically have fixed monetary values and don’t fluctuate significantly. Always keep all of your invoices, bills, and receipts for your damages. They act as proof of the damages you sustained and make it easier for our lawyers to calculate your settlement.
Non-Economic Damages
Non-economic damages don’t have any fixed values. How much they’re worth depends on several factors surrounding your case. Non-economic damages typically include:
- Loss of consortium
- Loss of enjoyment of life
- Pain and suffering
- Wrongful death
- Mental anguish and emotional trauma
- Disfigurement and disability
Even though money can’t fix or replace everything you’ve lost, it can give you the means to move forward with your life comfortably. We won’t let the insurance company try to downplay the extent of your catastrophic injury. We use various formulas to factor all of your non-economic damages into your settlement.
You Could Receive a Reward for Punitive Damages
The Official Code of Georgia Annotated (OCGA) §51-12-5.1 allows you to recover a reward for punitive damages. In order to qualify for this reward, your catastrophic injuries must have resulted from an accident that occurred due to:
- Egregious negligence
- Malicious intent
- A criminal act
Not all cases qualify, but most do. Remember, punitive damages aren’t part of a compensatory settlement. They exist to punish the at-fault party for their actions. If your case can qualify, our lawyers will ensure that you get a reward.

Distance is no obstacle. We work with clients across the country and make sure every one of them feels taken care of, no matter how far the call travels.
What Will My Settlement Be Worth?
Your settlement amount can vary depending on the circumstances surrounding your case. There’s no way to tell what the average catastrophic injury settlement is worth due to how different each case can be. Ultimately, for an accurate estimate, you’ll need to get in touch with one of our lawyers in Acworth.
Should I Accept the Initial Settlement Offer?
Never accept the initial settlement offer. When an insurance company tries to get you to settle quickly, it’s never in your favor. If you settle too early for their offer, you will end up with a lowball settlement guaranteed. Before you speak to anyone about your claim, get solid legal representation first.
