Undocumented Immigrant Workers’ Compensation Lawyer in Atlanta

If you’ve been injured at work and do not have legal immigration status, you still have rights. At John Foy & Associates, we help undocumented workers access benefits after serious job-related injuries. An undocumented immigrant workers’ compensation lawyer in Atlanta can guide you through the claims process and protect you from employer retaliation.

Many undocumented workers fear reporting an injury because of their status. But under Georgia law, your right to workers’ compensation is not tied to citizenship. A trusted Atlanta workers’ compensation lawyer from our team can help you take the next step safely.

Your Rights as an Undocumented Worker in Georgia

In Georgia, workers’ compensation laws apply to all employees, regardless of immigration status. If you are working and get injured while performing your job duties, you are entitled to the same benefits as any other worker.

These benefits can include:

• Medical treatment for your injury

• Weekly wage replacement if you cannot return to work right away

• Disability payments if your injury causes permanent harm

At our workers’ compensation law firm in Atlanta, we often hear from undocumented workers who were told they have no rights. That is simply not true. We have helped many undocumented individuals receive the care and compensation they were owed under the law.

What Our Atlanta Attorneys Do for Undocumented Workers

Working with an Atlanta personal injury lawyer for undocumented immigrants can make the entire process less stressful. From the beginning, our team manages every detail of your claim to protect your rights and fight for the benefits you need.

We help you:

• Report your injury correctly and on time

• Gather the documents needed to prove your claim

• Access approved medical care

• Respond to insurance delays or denials

• Push back if your employer tries to retaliate

Employers and insurance companies sometimes use your immigration status to try to avoid responsibility. We know Georgia’s workers’ compensation laws, and we take fast action to prevent unfair treatment.

Common Employer Tactics After a Work Injury

After a workplace accident, some employers try to avoid filing a claim. This is especially true when the injured employee is undocumented. You might hear things like:

• “You weren’t officially hired”

• “We’ll pay you out of pocket if you don’t file anything”

• “You can’t get benefits without papers”

• “If you report this, immigration might get involved”

These are scare tactics. If your employer says anything like this, it is time to talk to a workers’ compensation attorney who handles undocumented worker cases in Atlanta. We understand these situations and know how to protect you legally.

What Benefits Are You Entitled To?

Once your claim is accepted, you may qualify for several types of compensation through Georgia’s workers’ compensation system. These benefits are designed to support your recovery and help replace lost income while you are unable to work.

• Medical expenses: All necessary treatment related to your injury should be fully covered by your employer’s workers’ compensation insurance. This includes emergency care, surgeries, diagnostic testing, prescription medications, follow-up appointments, physical therapy, and any long-term treatment you may need.

• Wage replacement: If your doctor says you cannot work for more than seven days, you may receive weekly income benefits equal to two-thirds of your average weekly wage, up to the maximum allowed under Georgia law.

• Disability compensation: If your injury causes permanent impairment, you may be eligible for additional compensation. This is based on a disability rating assigned by your doctor, which takes into account the type of injury, the affected body part, and the level of lasting damage.

In some cases, undocumented workers are misled or underpaid by employers who hope they won’t ask questions. At our Atlanta workers’ compensation law firm, we carefully review your injury details, wage history, and medical reports to make sure you are receiving the full amount you’re entitled to. We fight to correct underpayments and challenge any improper denials.

Will You Risk Deportation for Filing a Claim?

No, filing a workers’ compensation claim does not put you at risk of deportation. The workers’ compensation process is handled through Georgia’s state insurance system and does not involve federal immigration enforcement.

Your employer is not legally allowed to threaten you based on your immigration status. If they do, they could face serious consequences under the law. Our legal team keeps your information confidential and focuses only on securing the benefits you deserve.
