How to File a Burlington Coat Factory Workers’ Compensation Claim

Meet with an Atlanta Burlington workers’ compensation lawyer before you submit your claim. Your attorney will evaluate your case and verify that you’re eligible to file a workers’ compensation claim.

From here, they will guide you through the claims process, which consists of these steps:

1. Notify your employer about your injuries in writing. You have up to 30 days from the date you were injured to inform your employer. If you miss this deadline, you could compromise your workers’ comp claim.
2. Receive medical care. Workers’ compensation will cover your emergency medical care. Meanwhile, your employer can give you a list of authorized physicians who can provide follow-up care.
3. File Form WC-14. Submit your Notice of Claim to the Georgia State Board of Workers’ Compensation (SBWC) online or through the mail. In addition, send copies of this form to your employer and their insurance carrier.

You have a maximum of one year from the day that you suffered injuries at Burlington to file your workers’ compensation claim. Typically, insurance companies have 21 days from the date you submit your claim to investigate and approve or deny it. If an insurance company disputes your claim, it can take months or longer to settle it.

Reasons Your Burlington Coat Factory Workers’ Comp Claim Could Be Denied

Unfortunately, your Burlington workers’ compensation claim can be denied, even if you allocate substantial time and resources to file it in alignment with Georgia law. Your Atlanta Burlington workers’ compensation attorney can review your denial letter to find out why your claim was rejected.

Common reasons why workers’ comp claims are denied include:

• You waited too long to notify management about your work injuries.
• You didn’t provide sufficient medical records.
• Your injuries occurred while you were off the clock.
• Your injuries are related to a preexisting medical condition.
• You didn’t get medical care immediately after you were injured on the job.
• You failed a drug or alcohol test, which indicates that you were under the influence of drugs or intoxicated at the time that you were injured at work.
• You didn’t receive medical treatments from a doctor authorized by your employer’s insurance carrier.
• You were engaged in horseplay or misconduct that led to your injuries.

You have one year from the day that you were injured while working at Burlington to appeal your denied workers’ compensation claim. Expect your attorney to file your appeal, collect evidence, and present your case to an administrative law judge (ALJ). If an ALJ affirms the claim denial, your attorney can appeal further to the SBWC’s Appellate Division.
