Many motorcyclists on the road today are very responsible and exercise a great duty of care for others. However, negligent riders cost thousands of dollars in damages whenever they cause an accident to happen. The Official Code of Georgia Annotated (OCGA) §51-1-6 allows you to file a claim against a negligent party after they’ve caused you to sustain damages.
Even if the law supports you, you still should seek the help of one of our Athens negligent rider accident lawyers. They can help you start filing your claim and represent you during a trial or negotiations. To receive your free case review, give our law office a call today at (404) 400-4000.
We Can Help You Recover a Settlement for Your Damages
There are many damages that our negligent rider accident attorneys can help you recover compensation for. While we can’t list them all, you should rest assured knowing that so long as your damages were directly related to your accident, you can factor them into your settlement.
Vehicle Repair and Replacement
A negligent rider accident can cause your car to suffer from several damages. Any car owner knows that even a simple scratch on your paint can cost several hundred and even thousands of dollars to properly fix, and that’s only for a scratch. Most car accidents result in damages much heavier than a scratch.
There are even times when the damages to your car are so extensive that repairing it would be pointless. Whether your vehicle needs to get fixed or replaced, our attorneys have you covered. We will factor in the amount it takes to do so and ensure that it gets appropriately reflected in your settlement.
Mental Anguish
Mental anguish can take many different forms after a negligent rider accident:
- Post-traumatic stress disorder (PTSD)
- Anxiety
- Depression
- Nightmares
- Various types of emotional trauma
Insurance companies will try to make your mental anguish seem irrelevant or made up. However, it’s proven that car accident victims often suffer from PTSD or other types of mental pain that prevent them from enjoying and living life. We will always fight to ensure your mental anguish gets recognized and compensated.
Lost Wages
The injuries you receive from your negligent rider accident can take many months to heal completely. Even then, after you heal, there still may be lingering physical issues that will continue to negatively affect you permanently. All of these physical impediments from your accident can prevent you from working and earning a living.
When this happens, you could end up working reduced hours, taking time off, or even worse, losing your job altogether. The wages you lost can get recovered and reimbursed through financial compensation.
When Should I Start Filing My Claim?
You don’t have long to file your claim after your negligent rider accident. The state of Georgia only gives car accident victims two years to file their claims. Two years is not a very long time, and many people end up missing their deadline.
Our team isn’t trying to get you anxious, but you should have some sense of urgency. The best thing to do is:
- Start collecting evidence to build a strong case.
- Get medical treatment as soon as you can and finish it completely.
- Calculate all of your damages first before filing.
If you rush into filing your claim, you risk settling too early before all of your damages get finalized. This means that the insurance companies will give you a settlement way below what you actually need. The negligent rider accident lawyers at John Foy & Associates will ensure that you file at the right time so you can win the maximum amount of compensation.
Win Your Settlement from the Insurance Company Today
Insurance companies are large businesses. Their goals are not the same as yours, and you shouldn’t expect them to have any compassion for you after your accident. Always reject the initial settlement they offer and try not to talk to them until you get legal representation first.
With more than 20 years of legal experience, our attorneys know how to handle insurance companies. We will fight hard on your behalf, and we won’t hesitate to go to trial for your settlement, unlike other law firms.
