Understanding How Rideshare Insurance Works
Rideshare insurance coverage is layered and depends on the driver’s status at the exact moment an accident occurs. Unlike standard car accidents, Uber and Lyft claims may involve multiple insurance policies, each with different coverage limits and rules.
The Driver Is Not Logged in to the Rideshare App
When a rideshare driver is logged out of the app, only the driver’s personal auto insurance applies. Most personal policies exclude coverage for commercial activity, which can lead to disputes or denied claims if the insurer argues the driver was engaged in rideshare-related conduct.
The Driver Is Logged in, Waiting for a Ride Request
When the driver is logged into the app but has not accepted a ride, Uber and Lyft provide limited liability coverage. This typically includes coverage for bodily injury and property damage, but at lower limits, and it may only apply if the driver’s personal insurance refuses to cover the claim.
The Driver Has a Ride Request or Passenger
Once the driver accepts a ride or is actively transporting a passenger, the rideshare company’s commercial policy applies. During this phase, Uber and Lyft generally provide up to $1 million in liability coverage, along with uninsured or underinsured motorist coverage in many situations.
South Carolina Is an At-Fault Auto Insurance State
South Carolina follows an at-fault auto insurance system, which means the driver who caused the accident is financially responsible for the resulting damages. After a crash, the at-fault driver’s insurance is expected to cover your losses.
Establishing fault is a critical part of any accident claim, especially in complex cases involving rideshare drivers and multiple insurance policies. Our experienced rideshare accident attorneys in Anderson pursue compensation from all available sources.
