What Is a Catastrophic Injury?

Catastrophic injuries can occur just about anywhere: on the job, playing or training for sports, in motor vehicle accidents or fires, as a result of a violent act against the victim, or from a fall.

Most often, people associate catastrophic injuries with spinal cord or brain injuries that lead to paralysis. Catastrophic injuries aren’t limited to those categories. They include any injury causing permanent and life-changing effects.

Loss of sight or hearing, birth injuries, nerve damage, cognitive impairment, and amputations, among other injuries, are all considered catastrophic as they change the life of the victim.

The Effects of a Catastrophic Injury

Catastrophic injuries leave victims permanently unable to work, care for themselves or others, or move through daily activities the way they did before the injury.

While victims are most affected by a catastrophic injury, family members of the victims also experience a life change. The victim most likely will not be able to work, causing a reduction in household income, and may not be able to contribute to household duties or child care. Sadly, the victim may not be able to communicate or engage emotionally with family members.

Why You Need a Catastrophic Injury Lawyer in Alpharetta

Compensation cannot take away the physical and emotional anguish caused by a catastrophic injury. However, an Alpharetta catastrophic injury lawyer can help you obtain the largest financial award possible, and that financial help will mitigate the unfortunate circumstances you and your family now face.

Though you may think the cause of your injury is clear and that other parties are responsible, those other parties and their insurance companies will fight to reduce their culpability and pay out as little as possible.

Your experienced lawyer from John Foy & Associates, the “Strong Arm of Georgia,” will meet that opposition head-on. You can trust this firm, with its history of major wins, to fight for the best interests of you and your family.

Determining Responsibility for Your Catastrophic Injury

Under Georgia’s modified comparative negligence law, injured parties can only recover damages for their injuries if they are found to be less than 50% responsible for the injury.

Should the victim fulfill this criterion, they can then recover damages in proportion to their determined responsibility. This means if a victim is found to be 20% responsible for the accident, they receive 20% less of what the full financial award would have been if they had been found 0% responsible.

A skilled Alpharetta catastrophic injury attorney will know how and what evidence to collect to build your case and what damages to sue for. Your attorney will not be intimidated or deterred by plaintiffs or insurance companies who may try to discredit your claims and avoid accountability.

How Winning a Settlement Can Help You and Your Family

After a catastrophic injury, you will need significant financial relief to sustain yourself and your family for years to come. Your catastrophic injury attorney in Alpharetta will seek compensation to cover those various losses and needs.

Medical Care

You may need surgery, physical therapy, psychological counseling, daily home care, or all of these interventions after your injury and you may need some of them long-term. Medical compensation can help cover bills and copays. And, as medical innovations are ever-developing, your compensation can ensure access to the newest and best medical treatments.

Loss of Income

Catastrophic injuries generally make it impossible for you to work at the same capacity as you could before your accident and may prevent you from returning to work at all. Your Alpharetta catastrophic injury lawyer will seek a settlement to recover lost wages and future earnings.

Even with a catastrophic injury, you still have to pay the bills. Recovering lost wages and earnings can provide the means to pay your rent or mortgage, keep the lights on, and put food on the table.

Pain and Suffering

The pain caused by a catastrophic injury goes beyond physical. There is also emotional and mental suffering as you work to accept that life has changed and will not unfold as expected. You may experience depression and anxiety or feel a loss of identity. You may feel isolated if unable to take part in social engagements.

Your injury may prevent you from participating in hobbies or recreational or social activities that once brought you enjoyment. You deserve compensation for this loss to your quality of life.

If your loved ones are caring for you, they will probably experience that isolation as well. If your injuries have left you unable to communicate with or recognize those around you, or have otherwise changed your cognitive abilities, your loved ones will suffer even more intense loss. These losses demand acknowledgment and compensation.

Other Expenses

You may face a variety of extra expenses as you adjust to your injury, and your Alpharetta catastrophic injury lawyer will assess your situation and seek comprehensive coverage.

For example, You may need to make structural changes to your property so you can safely access and navigate your living space, outdoor surroundings, and car, or experience new or increased child care expenses if you need additional hands to help care for your kids.
