QuikTrip Workers’ Compensation Claims

As an employee, you have the right to a safe place to work, meaning that you should not be hurt while you are on the job. Yet, accidents happen, and when they do, obtaining compensation for your losses, including medical bills and lost time at work, should not be a challenge. If you are struggling with QuikTrip workers’ compensation claims, we strongly urge you to be proactive in contacting John Foy & Associates for the legal guidance you need from an Atlanta workers’ compensation lawyer.

You Have the Legal Right to File a Claim

If you are hurt on the job at a QuikTrip and that location has at least three employees (most have many more), you then have the right to file a claim for workers’ compensation. These companies are required to maintain workers’ compensation insurance so that they can cover the cost of work-related injuries. In situations where you have injuries, follow these steps to get the legal support you need.

• Get the Medical Care You Need: In situations where there is an emergency, do not wait to get the medical care you need. Call 911 in life-threatening situations or go to the ER.
• Report the Accident to the Employer: Your employer will need you to document what occurred often through a written statement about what happened and what care you received.
• Follow Up with the Insurance Company: The management team is required to contact the workers’ compensation company or third-party administrator to file your claim. They will likely contact you to learn more about the incident, ask questions, and get an update on your medical status.
• Continue to Receive Medical Care: This is an important step. You need to do everything your doctor recommends, including resting, seeking out specialist care, and following up. This helps to prove your injuries and losses.
• Document All of Your Losses: We encourage you to fully document any losses you have, including anything you have to pay out of pocket due to your injury, medical costs, and lost time at work.
• File Your Claim: You will need to report your losses to the insurance company, and in most situations, it is fair to assume they will provide some pushback for the claim. However, you should receive compensation for the losses you document.

In most situations, minor medical claims can be handled right away. You can get back to work and move on with the job. However, in situations where you are struggling with your QuikTrip workers’ compensation claims, it may be time to hire a lawyer for a workers’ compensation claim.

When to Hire an Attorney for QuikTrip Workers’ Compensation Claims

Not every situation goes smoothly, and there are many times when you may be made to feel as if you cannot or should not file a claim. We encourage you to reach out to an attorney in those situations so we can provide you with the legal guidance you need. We encourage you to do this in situations like the following as well:

• You were not allowed to file a workers’ compensation claim for any reason.
• The workers’ compensation insurance company denied your claim, and you are not sure why.
• You were accused of reckless behavior, and that was the cause of your injuries.
• Your employer does not believe you were hurt on the job and denies your claim.
• The workers’ compensation company fails to provide you with a fair settlement.
• You need ongoing medical care and compensation for lost time at work over a long period.
• You may not be able to go back to work or do the same type of work again.
• You suffered emotional turmoil and trauma after the incident.

In each one of these situations, you may still be able to file a claim for workers’ compensation, but insurance companies are less willing and open to helping you secure that compensation. Our legal team at John Foy & Associates will fight for you. We have decades of experience to support you throughout this legal process, and we do not let you down.

What Your Responsibilities Are in Getting Workers’ Compensation

You expect the workers’ compensation insurance company to pay you fairly for what happened. While that may be the company’s responsibility, you are also responsible for several aspects of the process. Keep these tips in mind when it comes to workers’ compensation claims for QuikTrip.

• See a doctor to prove your injuries, and be sure to be thorough about what those injuries are. This documentation early on is critical.
• Be open and honest about what happened and why it happened.
• Make sure you disclose any pre-existing conditions when filing your workers’ compensation claim (they are likely to find out about them otherwise).
• Avoid posting on social media or otherwise defaming the company or insurance company while your case is pending.
• Avoid engaging in activities you are told not to by your doctor.
• Make sure you follow up and get all the medical care you require.
• Follow up with the workers’ compensation insurance adjuster and provide the medical documents and records you requested.

When you take these steps, you are doing what you are responsible for in getting the compensation owed to you. It is never a guarantee that the process will be simple or smooth, but you will find that there are trusted professionals like our attorneys ready to help you. When you are hurt on the job, know that you are not alone, and we will be there to help you get the results you need.
