The cost of a traumatic brain injury (TBI) can be substantial. This injury can impact an individual’s ability to go to work and earn a living wage. As such, the injury can have long-lasting ramifications on an individual’s finances.
An individual can experience a TBI due to someone else’s negligence. In this instance, the individual may be solely responsible for any medical costs relating to their injury. However, partnering with a personal injury lawyer can help this individual recover damages.
John Foy & Associates is a law firm that has handled many TBI cases to date. We can help you reach an experienced Stonecrest personal injury injury lawyer. Once we do, our lawyer can help you win your TBI case.
TBIs Can Require Expensive Medical Treatments
Research indicates over 5 million people in the United States live with a TBI. The estimated cost of living with this injury exceeds $37.8 billion annually. TBI treatment costs can be overwhelming, and they are unlikely to subside after injury onset.
For those who experience a TBI caused as a result of someone else’s negligence, do not expect the at-fault party to pay damages – at least not willingly. The at-fault party may do everything in their power to avoid taking responsibility. This party may even try to blame the victim for the injury.
Following an incident that causes a TBI, consult with a personal injury lawyer. At this point, the attorney can learn about the incident and how it resulted in a TBI. The attorney can also determine if an individual has a valid claim for damages.
An Individual May Be Eligible for Damages for a TBI If an At-Fault Party Breaches Their Legal Duty
In Georgia, a legal duty to a standard of due care applies. State residents must take reasonable measures to minimize the risk of injuring others. If a resident violates this duty and causes an injury to someone else, the injured party can pursue damages.
For example, an individual can experience a TBI in a car accident. If the accident occurred due to another driver’s negligence, this driver can be held responsible. At this point, the accident victim can seek damages from the driver.
It is beneficial to consult with a traumatic brain injury lawyer in Stockbridge to learn the ins and outs of personal injury law. The attorney can review an individual’s TBI case to find out if the aforementioned legal duty was breached. This lawyer can help their client pursue the maximum amount of damages, too.
The Amount of Damages that an Individual Can Pursue in a TBI Case
A Stockbridge traumatic brain injury attorney examines evidence relating to their client’s TBI case. This helps the attorney build a strong argument for their client. It ensures the attorney can file a lawsuit for a fair amount of damages as well.
After a person experiences a TBI, it is crucial to track all medical expenses relating to the injury. This individual should also monitor any loss of wages caused by the injury. The individual can share this information with their attorney in the initial stages of the legal process.
An attorney can collaborate with their client to determine the financial impact of a TBI. The lawyer can then file a lawsuit that accounts for costs associated with the injury. From here, the attorney and their client can prepare for court.

A TBI Case Can Be Decided by a Judge or Jury
Once a TBI lawsuit is filed, the plaintiff and their lawyer plan accordingly. The lawyer can respond to their client’s concerns or questions about the legal process. This attorney can help their client get ready for their court date.
It can take several months or years before a TBI case goes in front of a judge or jury. During this time frame, an attorney and their client can collect and review evidence. They can continue to work together to strengthen their case.
A plaintiff should keep a close eye on medical bills and other costs relating to their TBI, too. The plaintiff cannot stop these expenses in the short term. Conversely, the plaintiff can provide information about expenses associated with their TBI in court to show a judge or jury why damages should be awarded.
What to Expect When a TBI Case Goes to Court
The time leading up to a TBI case court date can be stressful. A Stockbridge traumatic brain injury attorney helps their client manage stress. The attorney remains accessible and addresses any legal issues that crop up before a court date arrives.
On the day a TBI case goes to court, the plaintiff and their lawyer present their argument. The at-fault party and their attorney do the same. This gives a judge or jury an opportunity to hear both sides of the case.
If a judge or jury rules in favor of the plaintiff, this individual can be awarded damages. Comparatively, if a judge or jury rules against the plaintiff, this individual receives no compensation from the at-fault party. Or, there can be times when the plaintiff is awarded only a portion of the damages originally requested.
