A food delivery driver, delivery company, or another party may be liable for a DoorDash car accident. If a Dasher crashes their car into yours, call 911, get medical care, and report the accident to the police. In the days that follow, consult with a car accident lawyer in Atlanta to pursue damages from any at-fault parties.
Your lawyer will learn about your accident and find out how it happened. If there are grounds for a personal injury lawsuit, your attorney can request compensation. They will work with you to prepare an argument designed to compel a judge or jury to award maximum damages.
How Do You Determine Who Is Liable for a DoorDash Car Accident?
Consider the facts of your case carefully to determine liability. For example, a Dasher is more focused on their delivery than safe driving, takes their eyes off the road, and causes an accident that leaves you with an injury. In this case, hire a distracted driving accident lawyer in Atlanta, and they can gather evidence to prove this motorist was negligent.
You can use accident scene photos and videos, a Dasher’s phone records, and other proof to support your case. When you have an abundance of evidence, it becomes difficult for a liable party to dispute your argument. This could lead the party to propose a fair settlement, allowing you to get damages to cover all of your accident-related losses.
When in doubt about who is at fault for your DoorDash accident, seek legal help. Your lawyer will explain what to do to protect your rights after your car accident. They can also find ways to prove to a judge or jury that you are in no way at fault.
Can You Be Liable for a DoorDash Car Accident?
Unfortunately, you can be at fault for a car accident involving a Dasher. You are responsible for following the rules of the road. If you choose not to do so, you can make a mistake behind the wheel that results in an accident, and you can be held responsible financially for your actions.
A DoorDash driver can sue you for a car accident. Alternatively, the driver could notify DoorDash, which may get in touch with your auto insurance company to investigate. If this happens, your insurer may find you liable, and the business may cover some or all of the other driver’s losses for you.
There are times when you are not liable for a DoorDash car accident, but the other motorist blames you for the incident. Instead of going back and forth with this individual about who is liable, get help from a lawyer. From here, your attorney will represent your best interests and help you disprove the other party’s claims against you.
How Can You Prove Someone Is Liable for a DoorDash Car Accident?
Build a body of evidence, as your proof helps make it clear to a judge or jury that someone else is at fault. In addition, partner with an Atlanta car accident attorney. They will develop an argument that highlights how these elements of negligence were present at the time of your accident.
Duty of Care
This refers to a legal obligation to avoid doing anything that could put others in danger. You expect a DoorDash driver to take precautions to protect themselves and others against accidents. Much in the same way, you do everything in your power to drive safely and comply with Georgia’s traffic laws.
Breach of Duty of Care
A Dasher understands their responsibility to others but chooses to act recklessly or carelessly. At this point, they violate their duty of care, putting you and others in danger. They can cause an accident, which may have been prevented if they acted cautiously and reasonably.
Causation
Since a Dasher chose to breach their duty of care, they got into an accident. Now, you are dealing with an injury. If your lawyer can prove this individual had a duty of care, broke it, and caused your accident, you could receive damages.
Damages
You may get economic and non-economic damages based on your DoorDash accident. To secure these, you must show that the liable party’s actions have left you with quantifiable or subjective losses. Your attorney can calculate your damages and help you secure 100% of the compensation you are requesting.
Proving negligence is challenging, and a lawyer can assist. Your attorney understands the legal process and guides you every step of the way. They can help you get damages from a Dasher, DoorDash, or other parties that contributed to your accident.
