Common Truck Accident Injuries
Your truck accident lawyer in Russell County, GA will need to go over how your life has been affected by your injuries. Since many of the losses that are awarded in truck accident claims are subjective and based entirely on the effects of an individual’s damages, it is important to quantify your losses accordingly.
Many injury victims are worried that their injuries are not severe enough for a lawyer to take on their case. However, no matter what type of injury you have been diagnosed with, if your injuries are Influential financially, psychologically, physically, or emotionally, you may be entitled to financial compensation. With that being said, there are some types of injuries we see more often in commercial truck accident claims:
Traumatic Brain Injuries
Traumatic brain damage is one of the most severe types of injuries you can sustain in a collision. Your truck accident attorney in Russell County, GA will need to consider how your injuries will likely continue affecting your life in the future. This information helps maximize the amount of compensation you are awarded.
It is not unusual for victims of second impact syndrome, penetrating brain injuries, diffuse axonal injuries, concussions, or other types of head injuries to require ongoing medical treatment or home health care for years or indefinitely after the accident.
Emotional Trauma
The emotional trauma of a truck accident can often be difficult to cope with. Victims often develop depression, anxiety, and experience post-traumatic stress disorder (PTSD). This can cause weight loss or gain, self-harming behaviors, suicidal thoughts, insomnia, flashbacks, and other debilitating symptoms.
When people suffer severe emotional trauma after a big rig accident, it can be difficult or impossible to continue going on with their lives.
Other Commercial Truck Accident Injuries
Traumatic brain damage and emotional injuries are not the only types of injuries seen in tractor-trailer crashes. There are many other types of injuries that could warrant legal action as well. Some examples of these injuries include:
- Lacerations
- Sepsis
- Organ failure
- Whiplash
- Road rash
- Neck injuries
- Back injuries
- Spinal cord injuries
- Paralysis
- Amputation
- Broken and fractured bones
Causes of Truck Accidents in Russell County
Your truck accident lawyer will get started on your case by figuring out how the accident occurred. Evaluating the cause of your collision will help to uncover potentially liable parties. In truck accident claims, it is not uncommon for there to be multiple parties who share fault.
Some of the more common ways in which truck accidents occur include:
18-Wheeler Defects
When tractor-trailers are defective, they won’t function properly. 18-wheelers are massive in size and need to be functioning correctly at all times. If they are not, they are not safe, even at rest. Whether there are defects in the steering column, tires, braking system, or other internal systems, if the truck driver is attempting to operate the vehicle and is unable to do so as intended, catastrophic injuries could occur.
Negligent Truck Driving
Truck drivers have a greater duty of care on the roadways than other types of drivers on the road. This is because the vehicles they drive are far more likely to cause injury or death. When truckers fail to uphold safety laws and regulations in any way, they can cause life-threatening injuries or death.
Some examples of negligent truck driving could include:
- Speeding
- Drunk driving
- Drugged driving
- Tailgating
- Road rage
- Failure to yield
- Failure to stop at a traffic light
- Failure to stop at a stop sign
- Making illegal turns
- Failure to use a turn signal on a highway
- Making unsafe lane changes
- Failure to check their blind spot
- Distracted driving
- Driving while fatigued
Trucking Company Liability
Trucking companies are frequently found liable for the injuries caused by truck accidents. Your Russell County truck accident attorney will carefully examine the circumstances of your case to determine whether the truck company in your case failed to uphold its duty of care.
Some of the top ways trucking companies can be held accountable for truck accidents include:
- Hiring truckers without conducting background checks
- Forcing truck drivers to work beyond federally regulated work-hour limits
- Failure to make necessary repairs to big rigs
- Failure to install working black boxes
- Failure to properly train truck drivers
- Fraud or misrepresentation of company records
Russell County Personal Injury Laws Impacting Your Case
There are several personal injury laws that could have an impact on the outcome of your truck accident claim. Some of the most important include Georgia’s modified comparative negligence laws and the statute of limitations.
Shared Fault in Russell County
Georgia follows a modified comparative negligence system. If you share less than 50% of the blame for the accident, you can still recover compensation for your damages at a reduced rate proportional to your percentage of liability.
Statute of Limitations and Other Deadlines
Getting your Russell County truck accident claim filed before the deadline expires is important. If you are filing an insurance claim, you might have as few as 30 days to file. If you are filing a civil lawsuit, you may have up to two years to file your claim according to the Georgia personal injury statute of limitations.
Unfortunately, if these deadlines pass and your claims are not filed, you lose your opportunity to recover compensation.
