If you have been injured in a motorcycle accident, an experienced Morrow personal injury lawyer from John Foy & Associates can provide guidance about the process of pursuing compensation for your injuries through the personal injury claims process.
The Difficulties Motorcyclists Face When Seeking Compensation
Motorcyclists often face a number of difficulties when seeking compensation for their injuries, not the least of which is the judgment of others regarding their chosen transportation. Motorcycles are often regarded as dangerous, and their riders are regarded as thrill-seekers. These judgments can be present in the insurance industry, the medical industry, and even the legal field.
It is important to work with a motorcycle accident lawyer who understands you have a legal right to operate your motorcycle on public roadways, as well as a legal right to seek compensation for injuries resulting from negligent drivers.
How Morrow Motorcycle Accident Lawyer Can Help with Your Claim
While personal injury claimants are not required to hire an attorney to assist them with seeking compensation through the personal injury claims process, having one is strongly encouraged as they bring experience to your case.
They not only understand the legal process of seeking compensation, but also the amount of compensation that is needed to fully compensate an injury and the tactics that insurance companies often use to reduce or even eliminate the payouts on claims for damages caused by their insured.
Protecting You from Insurance Company Tactics
As explained by the Bureau of Labor Statistics (BLS), most insurance companies hire claims adjusters to evaluate, investigate, and settle claims on behalf of the company. It is important to remember that insurance adjusters work for a company whose interests lie in making money, not paying out claims. As a result, adjusters use a number of tactics to avoid payouts.
One common insurance company tactic involves making a ridiculously low settlement offer early after the accident has happened, when the injured party is still very much in recovery and likely beginning to worry about how bills are going to be paid.
The offer is often presented with the statement that this is the maximum the claimant can receive and is made when the injured party has not yet had time to discuss the value of their case with a Morrow motorcycle accident attorney.
Other ways insurance companies limit their losses is by convincing the claimant to release all of their medical records so they can search for pre-existing conditions, or even perusing the claimant’s social media for information they can use to reduce a claim.
A motorcycle accident lawyer in Morrow will manage communication with the at-fault party’s insurance provider in order to protect you from falling victim to these tactics.
Establishing a Value to Your Case
Another service your motorcycle accident attorney in Morrow can provide for you involves establishing a value to your case. Your case’s value is based on several factors, including:
- How much insurance the at-fault party has
- The severity of your injury and the likelihood of permanent disabilities
- The expenses you have incurred as a result of the accident, such as medical expenses and wage loss
- The psychological impacts you have incurred, including pain and suffering, and emotional distress
Managing Deadlines
As explained by Cornell University’s Legal Information Institute, the statute of limitations in a legal claim is the deadline a claimant has to file their claim in court. If they miss the deadline, they will be barred from seeking compensation for the expenses and impacts of their injury through the state’s civil court system. The statute of limitations on personal injury claims in Georgia is generally two years from the date on which the accident occurred.
An important responsibility of a Morrow motorcycle accident attorney is protecting their client’s right to seek compensation for the court by ensuring the claim is filed before the deadline arrives.
Determining Liability and Accessible Insurance Resources
In order to have a successful outcome to a Morrow motorcycle accident claim, the claimant must be able to prove that someone else was liable. Liability is proven by showing that the at-fault party owed a duty to protect other roadway users by driving safely and legally, that they breached this duty by taking unsafe actions, and that these actions resulted in the accident that caused the injuries.
A Morrow motorcycle accident lawyer will carefully examine the claim to determine all sources of liability and the associated insurance resources that can be accessed to compensate their client. Insurance resources are an extremely important factor in this process, as they are the means by which nearly all motorcycle accident settlements and awards are paid.
Providing Guidance
It is important to note that all the decisions made in a Morrow motorcycle accident case are the client’s alone to make. This includes decisions on whether to accept a settlement, make a counter-offer in settlement negotiations, or proceed with the filing of the claim as a personal injury lawsuit in court.
Equally important is the willingness of the claimant’s attorney to provide guidance and clear communication in order to ensure that the decisions made serve the best interest of their client.
