Consequences of Negligence

Some people underestimate how costly a mistake can be for others. There are some mistakes that others cannot bounce back from. If a drunk driver hits another person and kills them, they cannot bring that person back.

Suffering a catastrophic injury after an accident has the same type of effect. While you are fortunate to be alive after your accident, it is more than likely that you will be permanently disabled after seeking medical treatment for your injuries.

Accidents that Cause Catastrophic Injuries

One of the most common accidents that lead to catastrophic injuries is motor vehicle accidents. These include car accidents, truck accidents, motorcycle accidents, bus accidents, and drunk driving accidents. The impact of these accidents, along with the rate at which all motorists were speeding, can cause all parties involved to experience serious and even fatal injuries.

Other accidents that can lead to catastrophic injuries are slip and fall accidents and workplace accidents. There are occupations where workers are often performing in dangerous work conditions, like construction.

Types of Catastrophic Injuries

Catastrophic injuries are injuries that cause the injured person to be permanently disabled. Some examples of these types of injuries include:

• Nerve damage
• Birth injuries
• Paralysis
• Brain injuries
• Traumatic amputations
• Facial disfigurement
• Burn injuries
• Fractured bones

The Lifelong Impact of a Catastrophic Injury

One thing is certain, whether your catastrophic injuries were caused by a car accident, motorcycle accident, bus accident, or a slip and fall accident. The injuries you endure will remain with you for the rest of your life. The following areas of your life that will be affected by your catastrophic injury include physical, mental, professional, relationships, and other areas of your life.

The Physical Impact

Your catastrophic injury may affect some or a majority of your physical capabilities. Your injuries may be so severe that you may be unable to walk again or speak without some additional assistance. You may also continue to experience some pain associated with your injury.

The Mental Impact

The catastrophic injury that you endure may affect your cognitive abilities. You may have difficulty performing cognitive abilities that you once found easy. In addition to the change in your cognitive abilities, you can also experience a change in your moods.

These changes can seem as if you are experiencing an emotional rollercoaster.

The Professional Impact

The physical and mental recovery from your injuries can affect your ability to perform your work duties. If there is a slight possibility that you can still work, you may have to do so with accommodations. Otherwise, you will have to retire early from the occupation you dedicated so much time and money to.

You may have to come to terms with the fact that you will no longer be able to work in any occupation.

Impact on Your Relationships

The physical and mental toll that your catastrophic injury will take on you will affect every relationship in your life. Your close family members may have to consider taking time off from their professions to become your caretaker. Because you are not working now, your household may experience a significant financial strain, bringing more stress to your family.

You also may experience some anger and grief at the changes that your injury requires and take those feelings out on your family.

Seeking Compensation for a Catastrophic Injury

While your body or mind may not be able to function as it did before your injury, you have the choice to recover financial compensation through a lawsuit. Suing for your catastrophic injury can help cover the monumental expenses required for your injury.

Because your injuries have made you permanently disabled, you must sue for an amount of compensation that will cover your expenses for the rest of your life. It is not unrealistic to list at least a couple of millions of dollars for catastrophic injuries.

Proving the Defendant’s Fault

The probability of success in your lawsuit depends on how well you can prove the defendant’s fault. Whether it is another car driver, bus driver, or a negligent company or manufacturer, you must prove that their negligence directly contributed to your catastrophic injury.

The case you can build for yourself will help establish the defendant’s liability in your accident. You will have to collect the right evidence that can add credibility to your argument.

How Insurance Companies Fight Back

You are entitled to larger compensation amounts as a person with a catastrophic injury. Because insurance adjusters understand the severity of your injuries, they will attempt to argue that you have some responsibility to bear in your accident. Even more insulting, they may argue that your injuries occurred from another incident other than the accident the defendant caused.
