Qdoba and Georgia Slip and Fall Accidents
Qdoba Mexican Eats used to be a subsidiary of Jack in the Box before being sold in 2018. Qdoba restaurants are known as “fast casual,” and they have over 700 locations throughout most of the United States and Canada.
As of 2020, there are eight Qdoba locations in Georgia:
- Alpharetta
- Atlanta
- Cusseta
- Fort Benning
- Fort Stewart
- Robins AFB
- Sandy Springs
The food served at Qdoba restaurants includes burritos, tacos, chile con queso, and quesadillas. Customers choose what items to include in their entree while going through a line where all ingredients are displayed. Food is prepared and served quickly, but it’s typically higher quality than strictly fast-food locations.
Every Qdoba location has a duty to keep their premises safe. Unfortunately, not every store is maintained at the highest standards, and if employees are negligent, it can lead to slip and fall accidents. A lot of the time, employee or manager negligence comes down to a lack of safety procedures in the store.
If you were hurt during a slip and fall accident in a Qdoba restaurant, you might be entitled to compensation for your costs. To know for sure, contact an experienced slip and fall accident and injury lawyer in Georgia as soon as possible.
How a Slip and Fall Accident Lawyer Can Help Your Qdoba Case
The thought of hiring a lawyer after your accident may be scary. Many people are worried that all a lawyer means is “expensive.” However, this is far from the case, especially when it comes to slip and fall claims.
Most personal injury lawyers work on contingency. This means:
- There are no upfront fees to start working with the lawyer.
- That they don’t get paid unless they win you money.
- If they do win you money, their fee is taken as a percentage of what you win.
- So, there are no out-of-pocket costs to you.
The purpose of a personal injury lawyer is to help injured individuals recover compensation for their financial costs. This compensation can help you pay for your losses from the accident, such as medical bills, lost wages, and pain and suffering.
Personal injury lawyers work in the context of tort law, which includes cases where injuries happen due to negligence. Legally, negligence means a failure to exercise reasonable care in avoiding harm to others. When it comes to slip and fall accidents, personal injury lawyers can help you seek compensation when a business’s negligence has led to your slip and fall injuries.
A slip and fall accident lawyer can help your case in many ways, including:
- Making sure you understand your rights
- Walking you through complex legal issues surrounding your slip and fall claim
- Helping you make the right decisions from an experienced attorney’s view
- Investigating all details of your case, including documenting the scene, interviewing witnesses, calling on experts, and gathering other information to build your claim
- Communicating with your medical providers about your injuries
- Negotiating with the insurance company for a fair settlement
- Calculating the full value of your damages (so you know what your case is truly worth)
A good lawyer will also be prepared to go to court with you. Thankfully, most slip and fall accident cases end in a settlement (meaning there is no need for a lawsuit). However, if your case does end up going to trial, your lawyer will be ready to help you prepare.
Choosing the Right Slip and Fall Accident and Injury Lawyer
It’s very important that you work with the right attorney for your case. Many lawyers will say they take on slip and fall cases, but do they actually have experience working on them? This is something you’ll need to ask about.
A personal injury lawyer who focuses on slip and fall accident cases is often known as a slip and fall accident lawyer. Damages You Can Recover in a Slip and Fall Case Against Qdoba
The exact damages you suffer will depend on the details of your case. In Georgia, damages are given as compensation when someone is found to be negligent in an injury accident (Georgia Code section 51-12-4). In your insurance claim, you will need to outline the damages you have suffered from your slip and fall accident.
Here are some of the most common damages slip and fall accident victims face in Georgia.
Medical Costs
Medical expenses typically make up the largest portion of an injury claim. In fact, you even have a valid injury claim in Georgia, you must have physical injuries. Medical costs that you can list in your claim include:
- Doctor bills
- Hospital bills
- Tests and surgeries
- Prescription medications
- Physical therapy
- And more
You’ll want to keep track of all bills and other evidence of your medical costs for your claim.
Lost Wages
If you have had to miss work time to get treatment for your injuries, you can claim lost wages in your case. You might need to present previous pay stubs or statements from your employers in the claim.
Lost Earning Capacity
If your injuries impact your ability to earn the same amount of income you did before, you may also be able to claim lost earning capacity.
Pain and Suffering
Pain and suffering damages account for the physical and emotional ways your injuries have impacted your life. Since pain and suffering damages cannot be proved through monetary amounts (like medical costs and lost wages), you’ll need help from a slip and fall accident lawyer who can help you demonstrate these damages.
