How to Know If Your Conyers Premises Liability Case Is Valid
After your slip and fall accident happens, you might worry that you’re to blame. It’s actually common for injury victims to automatically blame themselves or at least worry they are partially at fault. The truth is, people rarely fall for no reason—and the property owner or store may be more liable than you realize.
To have a valid slip and fall and premises liability case, you must have the following elements:
There Must Have Been a Duty of Care
Property owners and occupiers in Conyers have a duty of care to those who legally come onto their premises. They must maintain safe premises and practices to keep the location safe. If you were a legal visitor or customer on the property where you were injured, this duty of care would have been owed to you.
That Duty Must Have Been Breached
A breach of the duty of care mentioned above is known legally as “negligence.” Personal injury claims, such as slip and fall claims, in Georgia are based on the concept of negligence. If the property owner or occupier breached their duty to provide a safe place, it’s a form of negligence or carelessness.
Your Injuries Must Result from the Breach of Duty
If property owners or occupiers fail in their duty to provide safe premises and it leads to injuries, they are liable for damages (Georgia Code § 51-3-1).
So, to have a valid claim, you will need to show that the owner or store’s negligence led to your injuries. This part can be difficult, and it may require a lot of investigation and gathering of information for your claim. It’s best to consult with a Conyers slip and fall and premises liability lawyer who can help you compile the necessary evidence.
You Must Have Damages Directly Resulting from the Accident
After a slip and fall accident in Conyers, you may have damages like:
- Medical costs
- Lost wages
- Property damage
- Pain and suffering damages
In your claim, you will need to prove these damages and that they resulted from the slip and fall accident.
If you still have questions about the validity of your claim, contact a Conyers slip and fall accident lawyer as soon as possible. They can examine the details and let you know your options. Don’t assume you don’t have a strong case until after you’ve spoken to an attorney who understands these types of cases.
How to Build a Strong Slip and Fall Accident Case in Conyers
You can begin building your premises liability claim as soon as possible after your accident. Here are some ways you can start gathering evidence that you and your lawyer can use to seek the compensation you deserve.
Document the Scene
After your slip and fall happens, if you are well enough to do so, check out the scene. Identify exactly what caused you to slip and fall. Where did it happen? What was the hazard? How did it leave you injured?
Use your phone to take pictures of the hazard, the entire accident scene, and your injuries. The more you can document how the scene looked and what happened, the better for your claim. Pictures preserve what occurred long after a property owner or store employees have cleaned up the scene.
Make Notes on the Accident
Write down everything you can remember about the moments leading up the accident and the actual accident. You can also note how the slip and fall has impacted you going forward. If you have any torn or bloody clothing or shoes from the accident, save these for evidence.
Talk to Witnesses
Many times, other people are witness to slip and fall accidents in Conyers. Talk to anyone else who saw your accident or the hazard that caused it. Ask about what they saw, and get their name(s) and contact information.
Your lawyer will likely want to reach out to any witnesses later for statements.
Report the Accident
Make sure the property owner or business knows that you were in an accident and were injured. The business might ask to file an accident report. This is usually fine as long as you just stick with the facts.
Do not apologize or admit any blame in the accident. Anything you say could be used against you later, as the owner or business may be looking for ways to reduce their liability. Wait to talk to a Conyers slip and fall and premises liability lawyer before you discuss any additional information with anyone—especially the owner’s insurance company.
Get Medical Treatment
After you leave the scene, be sure to have a doctor look at your injuries as soon as possible. Getting immediate medical treatment will show that your injuries are serious enough to require attention. It also creates more record of the accident and your damages right after your fall.
If you wait too long, the insurance company may try to say you weren’t hurt as badly as you’re claiming.
Talk to an Experienced Slip and Fall Lawyer in Conyers
Beginning days after your accident, the property owner’s insurance company will likely start looking for ways to reduce what they pay on your claim. To level the playing field and make sure your rights are protected, it’s best to contact a slip and fall and premises liability lawyer as soon as possible.
Reach out to an attorney who understands slip and fall cases in the Conyers area and schedule a consultation. That way, you can create a plan of action and make sure everything you do is helping your case—and not hurting it.
