Determining the Cause of Your Accident
Tow truck drivers often speed to accident scenes or calls for totaled vehicles. If drivers aren’t careful, they can cause a collision. And unfortunately, passenger vehicle occupants often seriously suffer from these crashes.
If you were injured in a tow truck accident, you’ll need to know the cause. From there, you can determine who is responsible for your accident costs. You’ll know where to file a legal claim.
A crash can happen for many reasons, including:
Driver Negligence
Tow truck drivers can work long hours, often overnight. An accident might happen because of:
- Driver fatigue
- Driving under the influence
- Distracted driving
- Speeding
- Failure to yield
These are just a few examples of driver carelessness. If a driver’s actions directly cause your accident, that driver has been negligent. And negligence (another word for carelessness) is what determines fault for an accident.
If the driver works for a company, the company might be responsible for the driver’s actions. If the driver is an independent contractor, you could have a claim against the driver.
Tow truck drivers must carry a commercial driver’s license (CDL), according to the Federal Motor Carrier Safety Administration (FMCSA). This comes with an extra responsibility to stay safe on the roads.
Vehicle Defects
Tow trucks are enormous vehicles that often carry other heavy cars and trucks. If something goes wrong with a truck part, the results can be disastrous.
If truck part failure caused the accident, the manufacturer could be liable. You could have a claim against the manufacturing company.
Poor Maintenance
Routine inspections are essential for any vehicle, especially tow trucks. Drivers and companies should ensure the truck is safe for driving.
If improper maintenance leads to an accident, the driver or tow truck company could be responsible. But the maintenance company that worked on the vehicle could also be liable.
Improper Loading
Tow trucks carry heavy vehicles throughout the city or state. Some trucks can transport multiple cars at once. If the driver doesn’t load the cargo properly, vehicles can slide off and cause serious injuries.
Fallen cars might crash into or smash other vehicles on the road. Deadly crashes have happened because of poorly-secured cargo on trucks.
No matter how your accident happened, you have options. Talk to a Columbus personal inury lawyer today about how to build your case.
How to Seek Compensation for Your Accident
If someone else caused your accident, you have a right to seek financial compensation. But the burden is on the victim to take legal action.
You must file a personal injury claim against the at-fault party.
For example, let’s say a tow truck driver is responsible for your accident. You must prove that:
- The driver owed you a duty of care.
- The driver breached his duty of care. In other words, he was negligent.
- Because of the driver’s negligence, your accident occurred.
- You suffered injuries because of the accident.
Demonstrating each point takes research and work. Thankfully, you don’t have to handle it alone. A tow truck accident attorney in Columbus can handle the details.

What Does an Accident Attorney Charge?
The fee for a personal injury lawyer is typically around 33% of the settlement or court award they win you. The fee might be higher if your case goes to court, but that also means you win a lot more.
Working with an accident lawyer is risk-free to the client.
Here’s what that means:
- The lawyer’s fee depends on what you win. For example, the lawyer would get 33% of what settlement the insurance company pays you.
- You don’t pay the fee unless you win compensation. If your lawyer doesn’t win your case, you pay no fee.
- You can hire an attorney without worrying about out-of-pocket costs.
The contingency fee structure works well for both sides. The lawyer only gets paid if they are successful, and the client can get legal help without the risk. You can rest assured knowing your attorney has your best interests at heart.

What to Look for in a Good Lawyer
Finding an attorney who’s a good fit is crucial. You will need someone you feel comfortable talking to about the accident details. Just as importantly, you’ll need an attorney with the right skills and experience.
Here’s what matters.
Good Communication
You want to feel comfortable with your attorney. The relationship is professional, but it shouldn’t feel like an uphill battle.
A good lawyer should make communication easy. They should explain what you can expect and answer any of your questions. When you end the consultation, you’ll want to feel good about the interaction.
Solid References
An experienced law firm will have data to back it up. Don’t be afraid to ask for references or examples of cases like yours. A trusted firm will be happy to provide them.
We can provide specific examples of truck accident cases we’ve won, many ending with millions of dollars in results.
Relevant Experience
The best attorney will be familiar with your case type. If you were injured in a truck accident, work with a lawyer who has worked on truck accident claims.
Also, ask if the attorney has taken cases to court. Some law firms look flashy and impressive on the billboards, but they mostly act as quick settlement mills. You want someone who is not afraid to take your case to court if it’s necessary.
Attention to Detail
The law office should feel organized and put together. A good lawyer will ask targeted questions and discuss the details. You should feel like the attorney is genuinely interested in your case and your best outcome.
At John Foy & Associates, we’ve known as the Strong Arm for a reason. We don’t back down from complicated claims, and we’re not afraid to fight for your rights.
