Common Reasons Why Cement Mixer Truck Accidents Occur in Columbus
A cement truck is unique since it must transport cement within a limited amount of time. Typically, cement trucks have about two hours to mix cement and make sure it remains workable. On average, the weight of a cement truck with a mixing capacity of 10 cubic yards can be anywhere from 26,000 lbs. to 66,000 lbs., depending on its load. This can lead cement truck drivers to take risks when they are behind the wheel, leading to accidents.
Some of the reasons why cement truck accidents happen include:
Speeding
A cement truck driver may ignore posted speed limits due to concerns that the cement being mixed will harden. This can cause the driver to get into an accident with a passenger vehicle. Or, concrete can spill out of the truck, resulting in an accident.
Rollover
On average, a cement truck with a mixing capacity of 10 cubic yards can weigh anywhere from 26,000 lbs. to 66,000 lbs., depending on its load. If a cement truck driver carrying a heavy load makes a fast turn, their vehicle can tip. This can lead to a rollover accident.
Driver Mistake
Even a trained cement truck driver is prone to mistakes. It only takes a second for a cement truck driver to take their eyes off the road or make other errors. At any of these points, the driver can cause an accident.
If you get injured in a cement truck accident in Columbus, go to a doctor immediately. This allows you to receive medical care so you can treat your injuries. From here, reach out to a Columbus cement mixer truck accident attorney that can review your claim.

What It Takes to Show an At-Fault Party Is Liable for Your Cement Mixer Truck Accident
It is paramount to present evidence and witness testimony that shows any at-fault parties were negligent. To prove negligence, you must illustrate that these parties:
- Had a duty of care to act responsibly
- Breached this duty of care, which led to the accident
- Caused you to suffer injuries or property damage
Your lawyer works closely with you to collect and review evidence. In addition, your attorney seeks witnesses that can testify on your behalf. With sufficient evidence and witness testimony, you can compel a judge or jury to award you the full amount of damages you request.
How Your Cement Mixer Truck Accident Lawsuit Gets Resolved
It can take months or years before a judge or jury hears your cement mixer truck accident case. In the time leading up to your trial date, you and the defendant can negotiate a settlement. If you are presented with a settlement offer, you have the option to:
- Accept the proposal and close your case
- Decline the proposal and continue to move forward with your litigation
- Counter the proposal and give the defendant the opportunity to decide whether to accept it
When you get a settlement proposal, it pays to review it with your attorney. You can share any concerns or questions you have about the offer with your lawyer. This can help you evaluate the pros and cons that come with any decision you make about the offer.
You should not feel pressured to accept a settlement proposal that falls short of your expectations. If you receive a settlement offer but do not believe it accounts for the immediate and long-term costs associated with your accident, you can decline it without any penalties. At this point, your lawyer notifies the defendant, and you and your attorney keep building your argument for your trial.
