What Is Workers’ Compensation in Cayce, South Carolina?
Workers’ compensation is an insurance program that most South Carolina employers must carry. If you get hurt at work, you do not have to prove that anyone was at fault to qualify for benefits. However, you must show that your injury happened during your job.
Workers’ compensation benefits typically cover:
- Medical treatment costs
- Partial wages (about 66 2/3% of your average weekly pay) while you cannot work
- Permanent disability payments if your injury causes lasting harm
- Death benefits for surviving family members if a worker dies from a job-related injury
South Carolina law requires most employers with four or more employees to carry this insurance. It applies to full-time, part-time, and seasonal workers in most industries.

We Handle Common Issues With Workers’ Compensation Claims
Workers’ compensation is designed to protect injured workers, but it does not always work that way in practice.
Here are some common problems:
- Insurers deny claims due to paperwork errors or disputes over whether the injury is work-related.
- Employers delay reporting the injury or discourage you from filing a claim.
- Insurance companies offer low settlements that do not reflect the true extent of your damages.
- Medical care gets delayed or denied, preventing you from getting the treatment you need.
If any of this sounds familiar, our workers’ compensation attorney in Cayce will fight to protect your rights. Call us today for a free consultation.
How Long Do You Have to File a Claim for Benefits?
Under South Carolina Code § 42-15-20, you must report your injury to your employer within 90 days. The deadline to file a workers’ compensation claim is generally two years from the date of injury or discovery of an occupational disease.
Third-Party Claims Could Help You Recover More Compensation for a Work Injury
Workers’ compensation covers your medical costs and partial wages. But it does not pay for everything, such as pain and suffering or full lost income. If someone outside your employer injured you, you may be able to file a third-party claim for additional damages.
This kind of claim can apply in situations such as:
- A defective piece of equipment injured you (allowing you to sue the manufacturer)
- You were hurt in a car accident caused by another driver while working
- You were injured at a job site controlled by someone other than your employer
Our workers’ compensation claims attorney in Cayce, S.C., will review your case and tell you if you have a third-party claim. This is an important way to pursue full recovery when workers’ compensation does not cover all your losses.
What Should You Do After an Injury Happens at Work?
After a work-related injury, taking the right steps is very important:
- Tell your employer you got hurt: You should do this as soon as possible. Per South Carolina law, you must notify your employer within 90 days of the injury. Make sure you do this in writing. Waiting too long may harm your ability to collect benefits.
- Seek medical care: Go to the doctor your employer provides, if applicable. If you see your doctor without permission, your treatment may not be covered.
- Follow your doctor’s instructions: Attend all follow-up appointments and follow restrictions placed on your work.
- File a claim if needed: Your employer should file the claim for you, but sometimes they delay or deny your case. In that case, you may need to file Form 50 or Form 52 with the South Carolina Workers’ Compensation Commission.
- Speak with an attorney: Our workers’ compensation attorney in Cayce, S.C., will help you understand your rights and fight for the full benefits you deserve.
