The catastrophic injuries lawyer from John Foy & Associates focuses on cases where a person must adjust their entire life to handle a permanent injury. Catastrophic is a term to describe the severity of an injury. It does not represent the accident. When your injury falls under the catastrophic classification, it will be an uphill battle.
Many of these injuries refer to the spinal cord, brain, or a total loss of limb. Call a Cartersville personal injury lawyer to discuss your case today.
The Challenges of a Catastrophic Injury
Living independently or completing the same tasks you once had will be challenging. Medical conditions in this category require extensive care. Since the injury is permanent, you will undergo medical care for the rest of your life.
Many victims recover to a certain point where they can function but still require in-home care assistance. Other cases will require home or vehicle modifications to adjust to the person’s restrictions. Getting the highest possible payment for these cases is essential because it will be vital to the victim’s future.
These conditions are life-altering, and you must take that into account when you begin a compensation claim. Victims are fighting an uphill battle, and the medical process will be overwhelming. You should not have the legal battle ahead on your mind as well; that is the role that a catastrophic injuries lawyer in Cartersville will play.
Defining Catastrophic Injuries
Six conditions qualify as catastrophic conditions. These injuries are life-altering and can be life-threatening. You will suffer a significant reduction in your quality of life.
The six catastrophic conditions are:
- Loss of vision
- Amputation
- Paralysis
- Severe brain impairment
- Combination of impairments
- Extreme impairment from mental disorders
Even if your specific medical condition is not listed here, you should still speak with a Cartersville catastrophic injuries lawyer to review your options. Injuries that are not on the list but may still be catastrophic are:
- Spinal cord injuries
- Traumatic brain injuries
- Burn injuries
- Fractures
It is essential to have a Cartersville catastrophic injuries attorney review your injuries and your claim to determine whether you can file a claim under the catastrophic injury category. Even if you have severe damage that is not catastrophic, you can still file a personal injury claim to obtain compensation for your losses.
Causes of Catastrophic Injuries
There are many potential causes of a catastrophic injury in Cartersville, some more common than others. Some examples of accidents that result in a catastrophic injury are:
- Defective products
- Truck accidents
- Car accidents
- Workplace accidents
- Dangerous premises
- Pedestrian accidents
- Construction accidents
- Motorcycle accidents
- Medical malpractice
As you can see, you can suffer an injury in many ways. The deciding factor on whether you will suffer a catastrophic injury is how severe the accident is. When the accident is severe, the injuries will also be severe.
You will often see a catastrophic injury when a bus strikes a passenger vehicle. The size difference will contribute to the severity of the injuries. You should assess your damages with a catastrophic injuries attorney in Cartersville.

Legal Options After a Catastrophic Injury
You will need to file a legal claim depending on who was to blame for the accident. Several parties can be held liable when the accident is with a commercial vehicle. You will need to sue the insurance company when it is a singular driver.
These are some of the most complex legal cases, and it is imperative that you have a lawyer with the knowledge and experience necessary to handle your claim. The severity of these injuries might mean that the injury victim cannot speak for themself. The family may need to seek legal recourse while the injury victim is in recovery.
If the victim is in a vegetative state, there may not be a future where they can seek legal assistance. The family must step in and speak for them. Legal options are more complex when the family must act on behalf of the injury victim.
However, it is necessary to obtain financial recovery after a catastrophic injury.
Recovery After a Catastrophic Injury
To recover compensation after an accident, your Cartersville catastrophic injury lawyer must prove who the liable party was. More than one person can be held accountable, which can become essential to your recovery. Insurance companies might have caps on how much they can award for a particular injury.
Still, when several parties are liable, you have a better chance of recovery. Through a legal claim, you can garner compensation for:
- Lost wages
- Medical expenses
- Wrongful death
- Pain and suffering
- Property damage
- Loss of enjoyment of life
- Punitive damages
Multiple surgeries are common in these kinds of cases, and it is vital to calculate these damages in your recovery. You will also require long-term care and medical expenses for prescription medications and modifications. Do not hesitate to work with a Cartersville catastrophic injuries lawyer to find the best legal solution for your claim.
Timeframe to File a Catastrophic Injury Claim
Accident victims will not immediately contact a Carterville catastrophic injury lawyer because they do not have the finances to cover their services. While that can be a valid concern, catastrophic injury lawyers work under the personal injury umbrella and therefore have a contingency fee. That means injury victims do not pay anything out of pocket.
Your Cartersville catastrophic injury lawyer will only get paid when they get a settlement for your case.
