Catastrophic Injuries
A catastrophic injury can occur from many types of accidents. While the majority of accidents are severe, minor accidents can cause catastrophic injuries, too. Usually, catastrophic injuries occur to vital parts of the body and cause injury well beyond just the physical.
There are countless types of injuries that qualify as catastrophic. The most common include:
- Traumatic brain injuries
- Spinal cord injuries
- Organ damage
- Damage to eyes and ears
- Amputation
- Paralysis
Common Causes of Catastrophic Injuries
Catastrophic injuries can occur from many types of accidents. If you have been involved in any of the following types, you may have suffered a catastrophic injury:
- Severe vehicle accident
- Fall from a height
- Gunshot
- Construction site injuries
- Mining injuries
- Other workplace injuries
- Dangerous products
- Chemical exposure
Filing a Personal Injury Claim
When you suffer from a catastrophic injury, your only concern is your health and recovery. But you also need to be concerned with getting the compensation necessary to ensure you get the medical care and attention you deserve.
Your injuries are severe and could even be life-threatening. They are at least life-changing and getting immediate medical help is the best way to give you every possible chance of making a full and complete recovery.
To do that, you may need to file a personal injury lawsuit against the negligent person or company who caused your catastrophic injuries. Partnering with an experienced Gainesville catastrophic injury attorney can give you a leg up and increase your chances of getting maximum compensation.
Proving Negligence
To prove that someone else caused your catastrophic injuries, you need to prove that they were negligent. This requires showing that:
- Someone else owed you a duty of care to act safely or provide you with a safe product
- That person or company breached their duty of care
- Because of their breach, an accident happened where you suffered a catastrophic injury
This might seem obvious to you. You were there and you know exactly what happened. However, you will need to collect evidence to prove your case, and that’s something your legal team can handle for you so you can focus on your physical recovery.
Getting Compensation
The point of filing a personal injury lawsuit is to collect compensation. We know that no amount of money will undo the suffering and the pain you have had to endure. What this money will allow is for you to focus on your medical care. Getting money from the at-fault party will ensure that you can focus on your health and wellbeing.
Your Gainesville catastrophic injury lawyer may be able to get you compensation for:
- Pain and suffering
- Emotional distress
- Lost income
- Lost earning potential
- Loss of companionship
- Loss of life enjoyment
- Present and future medical expenses
- Rehabilitation costs
The expenses you face could be astronomical and could last for the rest of your life. The vast majority of personal bankruptcies filed each year result from an inability to pay medical expenses. You can avoid becoming a statistic by partnering with an experienced catastrophic injury lawyer in Gainesville who will work diligently to try and get you every dollar necessary.
Even a concussion, classified as a catastrophic traumatic brain injury, can result in millions of dollars of lifetime medical care for the victim. Our goal is to get you enough money so that you don’t pay a penny out of your own pocket for your medical expenses or your other financial losses that are directly related to your catastrophic injury.
Do Not Delay in Seeking Help
But you must act fast. From the date you get injured, Georgia law only gives you two years to file your personal injury claim. This is called a statute of limitations and your case must be filed before that clock runs out. If you miss this important filing deadline, you could miss out on your chance to collect compensation from the person or company who caused your catastrophic injury, your pain, your suffering, and the permanent changes to your life.
Working with a trusted legal advisor in Georgia can ensure that you meet this and all other important deadlines. Without that guidance, you risk having to shoulder the financial burden of your catastrophic injuries.
