When someone is irresponsible and chooses to drink and drive, people like you can suffer serious injuries. Their wrong decision can lead to a lifetime of medical treatment and you should not have to face that without fair compensation. The law can be confusing to understand while you are healing from your injuries.
That is when you need the help of a Pooler drunk driving accident lawyer from John Foy & Associates. We are the Strong Arm across Georgia, and we have won over $1 billion in settlements and jury awards for clients just like you. We offer free initial consultations to discuss your case and help you get started recovering what you are owed.
Determining Who Is Responsible for a Drunk Driving Accident
It may seem that the drunk driver who hit you is completely responsible for what happened. Filing a claim against them will be the first course of action. Other drivers owe one another a duty of care to drive safely and when a drunk driver breaches that duty, they should face civil penalties as well as any criminal ones.
However, Georgia law allows you to pursue others who played a part in the situation, such as anyone serving alcohol to the drunk driver. You may even find that another driver or entity caused or contributed to the crash. After discussing your case with a John Foy drunk driving accident lawyer in Pooler, you may find that you can also sue any of the following.
Social Hosts
Georgia liability laws for social hosts include the ability to sue party hosts who oversupply someone who then goes on to cause a crash. This includes any underage drinkers consuming alcohol with a supervising adult’s knowledge. You can pursue them for injuries and property damage, as well as suing the driver.
Dram Shops
A dram shop is any business or establishment that serves alcohol, such as a liquor store, restaurant, bar, or nightclub. Dram shop liability laws are meant to prevent overserving by making the business complicit in any injury, damage, or death the drunk driver goes on to cause. Uncovering evidence that a dram shop has served over-intoxicated people in the past who went on to hurt others can be valuable in filing a claim against the business.
Third Parties
In some instances, a drunk driver may hit you but did so because they were swerving to avoid debris in the road or another vehicle. If the third driver was being reckless, speeding, or also drunk, you could potentially include them in your lawsuit. If poorly maintained roads contributed to the crash, you could have the option of suing the overseeing government agency.
A skilled Pooler drunk driving accident attorney from John Foy & Associates will conduct a thorough investigation of the collision to ensure everyone at fault is held responsible.
Understanding the Value of a Pooler Drunk Driving Accident
A drunk driving accident can change your life in a split second. You may face injuries that leave you unable to work or even care for yourself. Even if your wounds are mild and you can fully recover, you should not be left to pay significant medical bills on your own. You need a drunk driving accident attorney in Pooler to help you calculate the value of your claim.
Even if the drunk driver is charged with criminal penalties, that does not help you. You should develop a list of the economic and non-economic losses you have suffered and at least file an insurance claim. If your injuries are especially severe, insurance may not be enough.
You may find the maximum compensation comes by filing a personal injury lawsuit with John Foy & Associates. Some common damages that you can pursue include:
- Medical bills (current and future)
- Medical or mobility devices
- Travel for treatment
- Emergency transportation (ambulance or helicopter)
- Auto repair or replacement
- Personal property damage (cell phone, computer, clothing, luggage)
- Pain and suffering
- Mental anguish
- Scarring and disfigurement
- Lost wages
- Permanent disability
- Diminished earning capacity
- Medications
- Home renovations to accommodate a disability
Each case is unique, and your attorney will help you search out every cost you can include. In situations where the damage is extremely severe, the judge may elect to award punitive damages. These are intended to harshly punish the defendants, such as a dram shop that overserves driversm and make them an example to others.
