Catastrophic injuries bring physical, emotional, and financial crises that can easily overwhelm you and your loved ones, especially if you do not receive fair compensation.
If you or a loved one has experienced a catastrophic injury, consult with a Dallas personal injury lawyer as soon as possible. Your lawyer will work toward a settlement that can help mitigate these crises and bring you a measure of relief.
Catastrophic Injuries Are Life-Changing
A catastrophic injury brings immediate and lasting changes to how you move through life. They are debilitating and often permanent. If any recovery is possible, it will come with intensive and extensive rehabilitation.
Consequences of catastrophic injuries may include
- Inability to work and earn income
- Required home care
- Permanent disability
- Reduced quality of life
- Physical pain and emotional suffering
- Long-term or permanent residency in a rehabilitative or nursing home facility
Sustaining such an injury will leave you with increased, intensive medical needs and financial losses. A Dallas catastrophic injuries lawyer from John Foy & Associates will help you meet those needs and recover those losses.
How Catastrophic Injuries Happen
While the effects of these injuries are catastrophic, the incident causing them doesn’t have to be. For example, serious motor vehicle accidents or building fires can cause a catastrophic injury, but so can seemingly minor slips, trips, or falls. You can also sustain an injury while training, engaging in recreational activities, or working.
Examples of Catastrophic Injuries
Catastrophic injuries can affect any part of the body or its systems. Some common examples are
- Traumatic brain injuries
- Paralysis
- Severe burns
- Spinal cord injuries
- Disfigurement
- Limb amputations
- Organ damage
- Loss of sight or hearing
Damages to Pursue After a Catastrophic Injury
The damages you pursue after a catastrophic injury depend on the severity of your injury and the extent of the consequences. Since catastrophic injuries are devastating, you will need significant financial relief.
Your Dallas catastrophic injuries attorney will determine a value for your case after thoroughly investigating all relevant circumstances. The specifics of each case vary, but your lawyer will likely pursue the following damages:
Coverage for Medical Expenses
Catastrophic injuries require medical interventions which can include surgeries, hospitalization, long-term rehabilitation, extended (or permanent) home care, and additional therapies. Your lawyer will seek coverage for your medical bills and for future related needs.
Recovery of Lost Income
The nature of catastrophic injuries will prevent you from working in the same capacity as you did before your injury and may prevent you from working ever again. Your lawyer will fight to recover lost wages and lost future earnings to bring you and your family financial security.
Compensation for Pain and Suffering
Physical and emotional pain follow catastrophic injuries. You may not be able to interact with family and loved ones as you once could, bringing a sense of loss and grief to all involved.
Adjusting to your disabilities may lead to anxiety, depression, or other emotional distress. This suffering deserves acknowledgment.
Restitution for Diminished Quality of Life
Moving through typical daily activities or even caring for your needs independently may not be possible following your injury. Engaging in social gatherings, special events, or vacations may also be out of reach. These losses reduce your enjoyment of life.
A financial award can help you afford accommodations allowing you to participate in those activities or provide access to new opportunities.

Negligence and Fault Laws Can Affect Your Settlement
If your injury was caused by someone else’s negligence, that party is “at fault” and required to cover the damages, often through their insurance. To be awarded a settlement, you will need to prove the other party was indeed negligent.
Proving Negligence
To prove negligence, your catastrophic injuries attorney in Dallas must show that the at-fault party owed you a duty of care, or an obligation to preserve your safety. For example, all drivers owe others on the road a duty of care. Store owners owe customers a duty to maintain a safe shopping environment.
Next, you must prove the at-fault party breached, or failed to fulfill, their duty of care. If a driver’s recklessness caused your accident, or if you slip on an untreated icy path into a store, the driver and store owner have breached their duties, respectively.
Finally, you must show those breaches led to your injuries, which in turn led to quantifiable losses.
Determining Fault
Georgia is a modified comparative fault state. Victims who are more than 49% responsible for the accident causing their injuries cannot collect a financial award. Victims who are less than 49% responsible, will see reduced compensation in proportion to their percentage of fault.
For example, if the victim holds 25% of the fault, they will receive 75% of the full compensation amount. To protect your potential settlement and your financial security, have a Dallas catastrophic injuries lawyer from John Foy & Associates, the Strong Arm of Georgia, manage your case and negotiations.
Responsible parties, and the insurance companies representing them, will aim to pay out as little as possible, often far less than you are entitled to and need to support yourself and your loved ones. These parties may use dishonest methods to overestimate your fault or use scare tactics to coerce you into accepting a low offer. Your lawyer will protect you from false accusations and will not fall for intimidating scare tactics.
