Can You Sue Tesla If You Are In an Accident?

Yes, you can sue Tesla under product liability laws after an accident for damages and injuries sustained. However, whether your case has merit will depend on the circumstances of your accident. You could have a valid claim if the accident were caused by:

• A defect in the vehicle
• Brake failure
• Battery problems
• Malfunctions in the Autopilot system
• Malfunctions in the Self-Driving system.

You could also sue for negligence if you can prove that Tesla did not give sufficient warnings or misrepresented the safety of their vehicle. Our skilled Columbus personal injury lawyers can review your circumstances and offer advice on whether you have a case against Tesla.

Tesla’s Safety Record

Technology should make cars and trucks safer, but studies over the past several years have shown that Tesla vehicles are more likely to be in accidents than other automotive brands, sometimes with horrific results.

Georgia has seen its share of Tesla tragedies over the past few years, including the following.

• A fatal traffic collision in 2020 in Cobb County claimed the life of a man at a bus shelter when a speeding Tesla hit the shelter at high speed.
• A fiery Tesla crash killed two people in Woodstock, Georgia, in December of 2023. The car burst into flames after the accident.
• A father and son were killed in a fiery Tesla crash in Thomas County in December of 2024 when the driver lost control, veered off the road, struck a tree, and caught fire.

These accidents suggest that Tesla cars and trucks may have flaws that can cause fatal accidents at a higher rate than other automotive brands.

How Much Is a Tesla Accident Case Worth?

Tesla has faced numerous individual and class-action lawsuits because of problems with their vehicles, and the settlements are typically confidential. The amount you may be able to recover in your suit will depend on the extent of your damages.

Your Columbus Tesla accident attorney will calculate your maximum compensation based largely on your economic damages. This will include things like:

• The costs of your medical care, like doctor visits, surgery, medications, and therapy
• Emergency services fees, such as ambulance transport and emergency room care
• Lost wages to make up for the earnings you missed if you were unable to work
Future medical care, like therapy, medications, and procedures
• Property damage

In some cases, your attorney may include non-economic damages such as pain and suffering and emotional distress. These are harder to prove and are meant to compensate you for the emotional, mental, and social hardships you’ve suffered.

Punitive Damages

A court awards punitive damages in cases where the defendant has behaved especially recklessly or negligently. These damages are meant to punish the defendant and prevent them from engaging in similar behavior in the future.

Punitive damages are rare, but they may apply in cases such as a Tesla auto accident. Sometimes, the threat of punitive damages means a company is more likely to settle out of court. Your attorney can let you know whether punitive damages might apply to your case.

How Our Attorneys Can Help

If you have been injured in a crash involving a Tesla vehicle, it is smart to contact an attorney as soon as possible. Our Tesla accident lawyers in Columbus offer free consultations, so there is nothing to lose by calling. Some of the ways we may be able to help include:

Case Evaluation

During your free consultation, we will listen to your story and advise you on whether your case is worth pursuing. If we believe you have a case against Tesla and you agree to hire us, we will develop a strategy to get you the compensation you need to cover your damages.

Accident Investigation

We will investigate the circumstances of your accident and determine how it happened. We may refer to accident reports, vehicle data, security footage, and witness testimony. We want to understand who is liable so we know how to move forward.

Damage Assessment

We’ll calculate your maximum compensation based on your damages. We can use this number to file your claim and later to negotiate for a fair settlement that will cover your costs and help you recover from your accident.

Negotiate Your Settlement

You don’t want to take on Tesla’s lawyers on your own. We’ll handle the negotiations, and if all goes well, that will be all it takes to settle your case positively. If negotiations don’t produce results, we will represent you in court.
