Can You Sue Tesla After an Accident?

If you are in an accident involving a Tesla vehicle, you can pursue legal action against Tesla. Possible claims might involve product liability, negligence, or wrongful death. However, the success of your case will depend on specific circumstances.

You may have a legitimate claim if the accident happened due to issues such as brake failure, battery problems, or malfunctions in the Autopilot or Self-Driving system. In these cases, Tesla could be held liable under product liability laws.

You might also be able to sue for negligence if you can show that Tesla failed to provide sufficient warnings or misrepresented the safety or capabilities of its technology. An Augusta personal injury lawyer can review your accident and let you know if you have a case.

Are Tesla Vehicles Dangerous?

Many people believe Tesla cars and trucks are safer due to their advanced technology. Still, data over the past few years reveals that Tesla vehicles are more likely to be involved in accidents than any other car brand.

In Georgia alone, there have been several serious accidents involving Tesla vehicles, including:

• In December of 2024, a father and son were killed in a fiery Tesla crash in Thomas County. The driver lost control of the vehicle, it veered off the road and struck a tree before bursting into flames.
• In September of 2020, a fatal traffic collision occurred when a speeding Tesla crashed into a bus shelter in Cobb County, destroying the shelter and killing a man.
• In December of 2023, a fiery Tesla crash killed two people in Woodstock, Georgia. This crash again caused the car to burst into flames.

These accidents suggest that despite cutting-edge technology, Tesla vehicles could be more dangerous than other car and truck brands.

What Damages Can You Recover in a Tesla Accident?

The settlements in Tesla lawsuits are confidential, so the total amount they have paid in damages to accident victims is unknown. Your award or settlement will depend on your injuries. Our Augusta Tesla accident attorneys will calculate your economic and non-economic damages.

Economic Damages

The costs and expenses you have incurred due to your accident and injury are considered economic damages. They are associated with a specific dollar amount, making them relatively easy to calculate. While each case is different, your economic damages may include:

• The cost of the ambulance and emergency room services
• Hospital stays
• Doctor and specialist appointments
• Medications required due to your injuries sustained in the accident
• Surgery and other necessary procedures
• Lost wages for the time you can’t work
• Anticipated medical costs, such as physical therapy, prescriptions, and procedures
• Property damage

If a loved one passes away due to an accident involving a Tesla vehicle or because of injuries sustained in an accident, the family may have grounds for a wrongful death lawsuit against Tesla.

Non-economic Damages

Due to the severity of your accident and injury, you may suffer in ways that have little to do with money. These hardships are known as non-economic damages, and while they are harder to prove, they may include things such as:

• Pain and suffering
• Mental anguish
• Emotional distress
• Scarring and disfigurement

Punitive Damages

Punitive damages won’t be part of a settlement. However, a defendant such as Tesla may be more likely to settle out of court if they believe there is a threat of punitive damages.

A court grants punitive damages when the defendant demonstrates extreme recklessness or negligence. The intent is to punish and discourage similar actions in the future. Your attorney can advise you on whether punitive damages are possible in your case.

How Much Does a Tesla Lawsuit Cost?
