If you’re injured while working at Wendy’s, report the injury to your supervisor as soon as it happens. Get medical care immediately, even if the injury seems minor, and tell the doctor it happened at work. Document everything: how the injury occurred, any witnesses, and all the symptoms you’re experiencing.
Wendy’s should provide forms to start a workers’ compensation claim, which can cover your medical bills and part of your lost wages. A Wendy’s workers’ compensation lawyer in Atlanta will protect your rights throughout the process.
Report the Injury Immediately
Tell your shift supervisor or manager as soon as the incident happens. If your location requires it or no manager is available, notify corporate HR following your store’s reporting process. Workers’ compensation claims depend on clear, documented proof that the injury occurred on the job. Waiting too long can lead to delays, questions, or even a denied claim.
When you report the injury, be specific. Explain:
- What happened
- Where it happened
- The exact time
- What you were doing
- How the injury occurred
- Any equipment or conditions involved
Mention anyone who witnessed the incident and describe your symptoms, even if they seem minor. The more accurate and detailed your report, the stronger your claim will be.
Seek Medical Attention
After a workplace injury at Wendy’s, get medical attention immediately, even if the injury feels minor. Some injuries, like strains, burns, or internal issues, may worsen over time if untreated. When you see a doctor, clearly explain that the injury happened at work.
In some states, your employer may require you to visit an approved medical provider. If this applies, follow the rules to avoid delays or complications with your claim. Prompt and proper medical care protects your health and strengthens your claim for benefits.
Document Everything
Write down exactly how, when, and where the injury happened, including what you were doing at the time. If possible, take photos of any hazards, spills, equipment, or visible injuries like burns or cuts.
Talk to coworkers who witnessed the incident and ask them to provide statements or notes about what they saw. Keep copies of all medical records, doctors’ notes, and any incident reports you submit to your employer.
Your Atlanta workers’ compensation lawyer will use all the available evidence to strengthen your claim.

Filing a Workers’ Compensation Claim
To file a claim, submit the required forms to your store manager or directly through Wendy’s insurance company, following your employer’s instructions. Pay close attention to deadlines, as most states require you to report the injury and file a claim within a specific time frame, often within days or weeks.
Workers’ compensation can provide important benefits if you’re injured at Wendy’s, including:
- Medical care for treatment, hospital visits, and prescriptions related to your injury
- Rehabilitation services, such as physical therapy or occupational therapy
- Partial wage replacement if you miss work due to your injury
- Temporary or permanent disability benefits if your injury affects your ability to work long-term
What Not to Do if You Are Injured While Working at Wendy’s
After a workplace injury at Wendy’s, there are a few important things you should avoid to protect your health and your workers’ compensation claim:
- Don’t ignore symptoms or try to “shake it off.” Even minor injuries can become serious if untreated.
- Don’t give a recorded statement to an insurance adjuster without understanding your rights. Statements can be used to deny or reduce your claim.
- Don’t return to work before a doctor has medically cleared you. Returning too soon can worsen your injury and affect your eligibility for benefits.
