What Steps Should Truck Drivers Take After a Work Injury?

When you’re injured on the job as a truck driver, it can be difficult to know what to do next. Questions about your health, your livelihood, and your rights might feel overwhelming as you deal with the aftermath of the accident.

So, what steps should truck drivers take after a work injury? Following the right process is essential for protecting your health and ensuring you receive the benefits you’re entitled to under workers’ compensation laws.

If you’re unsure where to start, an experienced Atlanta workers’ compensation lawyer can help guide you through the process and relieve some of the stress.

Prioritize Your Health and Safety

The first step a truck driver should take after a work injury is to seek medical care. Your health should always come first. Truck driving injuries can range from minor sprains and strains to more serious issues like back injuries, bone fractures, or even long-term conditions caused by repetitive stress.

Regardless of the severity, you need to get proper medical care right away.

Here’s what to do:

• Seek Immediate Medical Attention: If the injury is serious, call 911 or go to the nearest hospital. For less urgent injuries, visit your company’s designated healthcare provider if required by your employer.
• Document Your Injuries: Ensure the doctor documents your injuries thoroughly. This medical record will be crucial for your workers’ compensation claim.
• Follow the Doctor’s Orders: Whether it’s taking prescribed medication, attending physical therapy, or taking time off work, following the treatment plan is critical for both your recovery and your claim.

Report the Injury to Your Employer

In Georgia, workers’ compensation laws require you to notify your employer about your injury as soon as possible. Ideally, you should report it immediately, but you have up to 30 days to do so. Failure to report the injury within this timeframe could jeopardize your ability to receive benefits.

When taking steps to report a truck driving work injury:

• Be Specific: Provide detailed information about the accident, including what happened, where it occurred, and the nature of your injuries.
• Use Written Communication: While verbal reporting is often acceptable, it’s a good idea to follow up with a written report for your records.
• Request a Copy: Ask for a copy of the incident report to ensure everything is documented accurately.

Understand Your Rights Under Workers’ Compensation

Workers’ compensation is a no-fault system designed to provide injured employees with benefits without needing to prove fault. As a truck driver injured on the job, you may be entitled to:

• Medical Benefits: Coverage for doctor visits, hospital stays, physical therapy, and medications.
• Income Benefits: Partial wage replacement if your injury prevents you from working temporarily or permanently.
• Vocational Rehabilitation: Assistance with retraining or finding a new job if you can’t return to your previous position.
• Permanent Disability Benefits: Compensation if your injury results in a permanent impairment.

An Atlanta workers’ compensation lawyer can explain these benefits in detail and ensure you’re receiving everything you’re entitled to under the law.

Document Everything Related to Your Injury

A very important step for truck drivers to take after a work accident is to document your accident and injuries. Keeping detailed records can significantly strengthen your workers’ compensation claim. Here’s what to document:

• Medical Records: Save copies of all doctor visits, treatments, and prescriptions.
• Correspondence: Keep track of any communication with your employer, insurance company, or healthcare providers.
• Expenses: Record any out-of-pocket costs related to your injury, such as travel to medical appointments or equipment purchases.
• Work Impact: Note how the injury has affected your ability to perform your job or other daily activities.

Avoid Common Mistakes

Even small missteps can complicate your claim. Avoid these common mistakes to protect your rights:

• Don’t Delay Reporting the Injury: Waiting too long to report the accident could weaken your case.
• Don’t Delay Medical care: You don’t have long to see a doctor after a work injury. A delay can lead to debate about the cause of your injuries.
• Don’t Ignore Medical Advice: Failing to follow your doctor’s treatment plan might give the insurance company a reason to deny your claim.
• Don’t Sign Anything Without Legal Guidance: You may be asked to sign forms or settlements that aren’t in your best interest. Always consult a lawyer before signing.
