Types of Improperly-Loaded Cargo in Marietta

Truck drivers carry all sorts of cargo through Marietta each day. If a truck gets into an accident, it can be deadly for other drivers. No matter the type of cargo, a truck driver must properly load the contents to prevent spills.

Types of cargo that truckers carry can include:

• Chemicals
• Food products
• Flammable liquids or gases
• Explosives
• Cars and other vehicles
• Work equipment
• And much more

Many types of cargo can be hazardous in an accident. Even if a material is not dangerous on its own, large amounts can cause injuries after spilling into the roads.

The party responsible for loading and securing cargo must be incredibly careful. If something goes wrong, the results can impact many lives. The at-fault party should be held accountable for the damages they’ve caused.

How Poorly-Loaded Cargo Causes Car Accidents

Cargo loading issues can occur in many ways. A car accident can happen because of:

• Defective (or not enough) tie-downs on the cargo.
• Hazardous materials that seep through the truck.
• Imbalanced cargo.
• Improper truck maintenance.
• Failure to check cargo for secure loading.
• Improper loading methods.
• Overloaded cargo.

Cargo can fall off of a truck and injury other drivers on the road. Large objects can block the road or fall onto other motor vehicles. If a cargo-carrying truck rolls over, its contents can fall out and cause further damage. Some materials can cause the truck or other vehicles to catch fire.

Improperly-loaded cargo can lead to many types of issues on Marietta roads. If you or a loved one suffered injuries, you should not have to pay. An experienced car accident lawyer can investigate to determine who was at fault.

You deserve the fullest compensation possible after an improperly-loaded cargo accident. To learn more about your legal options, contact John Foy & Associates today. Call us at (404) 400-4000 or contact us online to schedule a FREE consultation.

Proving Negligence in an Improperly-Loaded Cargo Accident

Personal injury cases depend on the concept of negligence. Under Georgia Code Section 51-1-2, negligence is the lack of care that “ordinarily prudent persons” have under similar situations. If someone is negligent, they are not being careful enough to avoid causing harm.

When someone is negligent in an improperly-loaded cargo accident, they are legally liable. As an accident victim, you can seek compensation from the at-fault party. An experienced lawyer can help you file a personal injury claim.

To prove negligence in your claim, you’ll need to show that:

• There was a duty of care.
• The responsible party breached its duty of care.
• The breach of duty caused your accident.
• You suffered injuries because of the accident.

Any losses you have because of your injuries are your “damages.” There are two primary types of damages: special and general (Georgia Code Section 51-12-2).

Special damages are financial losses like medical bills and lost wages. You can prove these damages through documentation. General damages are about how your injuries impact your life. They include mental anguish or pain and suffering.

An experienced Marietta lawyer can help calculate all of your damages. You’ll need to know what fair compensation looks like for your claim.

Responsible Parties in an Improperly-Loaded Cargo Crash

Several people could be at fault in a Marietta car accident caused by poorly-loaded cargo. The at-fault party could be:

• A truck driver carrying the cargo
• The truck driver’s employer
• A company that handles the loading of the cargo

Truck drivers should regularly check their cargo to ensure it’s secure. However, the person who loaded the shipment should have done so carefully, too. If someone fails in their legal duty, they could be responsible.

You’ll need to determine who was at fault for your car accident. From there, you’ll know where to file a personal injury claim for compensation. Talk to an experienced lawyer who can help you investigate today.
