How Liability Works in North Augusta Lyft Accident Cases
Liability means figuring out who is legally at fault for the crash. In Lyft accidents, this can get tricky because it’s not always just one person or one company to blame.
Who Could Be at Fault?
- The Lyft driver: If they were distracted, speeding, or breaking traffic laws, they might be at fault.
- Another driver: Sometimes a different driver causes the crash, not the Lyft driver.
- Lyft: Lyft can be responsible in certain situations, especially if they didn’t check a driver’s background or failed to remove someone who was unsafe.
How Lyft’s Insurance Works
Lyft drivers are independent contractors, not employees. That means Lyft doesn’t automatically take full responsibility for every crash. However, Lyft does have insurance coverage to help if something goes wrong, depending on what the driver was doing at the time:
- If the driver was not using the app: Lyft’s insurance does not apply. The driver’s own car insurance must cover the crash.
- If the driver had the app on and was waiting for a ride request to come in: Lyft offers limited coverage—usually up to:
- $50,000 per person for injuries
- $100,000 total per accident
- $25,000 for property damage
- $50,000 per person for injuries
- If the driver was on the way to pick up a rider or had a rider in the car: Lyft provides $1 million in coverage for injuries and property damage. This is the highest level of coverage.
We Will Work to Determine Who’s At Fault for the Crash in North Augusta
Understanding who is at fault and which insurance applies can be confusing. That’s where we come in. We will:
- Look at driver activity in the Lyft app
- Check Lyft’s insurance coverage
- Talk to witnesses and review camera footage
- Handle all insurance communications for you
We will build a strong case to show who should pay for your damages—so you don’t have to figure it out alone.
What Happens If Lyft Doesn’t Cover the Accident?
When Lyft’s insurance won’t cover an accident, here’s what that could mean for you:
If the Lyft Driver Wasn’t Using the App
If the driver didn’t have the Lyft app on when the accident happened, then Lyft’s insurance won’t apply. That means the driver’s car insurance has to pay for any injuries or damages.
In this situation, our Lyft accident attorney in North Augusta will:
- File a claim with the driver’s insurance company.
- Make sure the insurer pays what it should.
- Go after other at-fault parties if needed.
If the Lyft Driver’s Insurance Isn’t Enough
Sometimes, even if the driver’s insurance applies, it may not be enough to cover all your damages, especially in serious crashes. When that happens, our team will:
- Look for other sources of insurance, like an uninsured/underinsured motorist policy you may have.
- See if multiple people or companies could share the blame.
- Push for full damages through every available option.
What If You’re Left With Medical Bills?
If you’re stuck with medical bills or lost wages after a crash, we won’t let you face it alone. Our team will fight for the full amount you deserve so that you’re not left paying out of pocket for someone else’s mistake.
