Although Lilburn is a suburb of Atlanta, it still sees a lot of the same accidents that happen on the big highways. One of the most frequent kinds of crashes is a rear-end collision. When a driver fails to leave enough distance and slams into the back of your car, you can suffer injuries and property damage. You need compensation for what you have lost.

At John Foy & Associates, we are the Strong Arm in Georgia, and we fight for the justice you deserve. When you or a loved one has been hurt by someone hitting your car from behind, you need a skilled Lilburn rear-end collision lawyer to protect your rights. We listen to your story and begin building a case to show how the other driver is to blame.
Why Rear-End Collisions Happen
Most rear-end collisions happen at intersections when a driver is waiting to turn right or left, and the driver coming behind fails to stop in time. They may not see the stopped car, or they may not be paying attention. Regardless of why the driver hits your vehicle, they will likely be considered at fault.
The National Highway Traffic Safety Administration (NHTSA) reports that rear-end collisions are the most common type of accident in the US. Over 80% of these crashes happen when the front driver stops or slows down. Every driver must follow at a safe distance and allow enough space to stop without causing harm or damage to anyone.
Distracted driving is a major factor in rear-end accidents. People may be riding in heavy traffic while talking on the phone, texting, watching videos, fumbling for something in the car, or engaging in personal grooming. All these behaviors can take their attention off the road and cause them to hit the back of your vehicle.
Potential Value of a Lilburn Rear-End Collision Claim
When you have been hit from behind, you will naturally turn to your insurance company for compensation and likely file a claim against the other driver’s policy. This may not be enough to cover all your expenses. Insurance companies can pressure you to accept a low offer quickly so they can close the claim. They protect their bottom line by paying you less.
A qualified rear-end collision lawyer in Lilburn from John Foy & Associates can prevent this from happening to you. We will negotiate with insurance representatives to get every penny you deserve. Our team will assess your case and estimate the potential value of your claim.
Every situation is unique, so your claim may be worth more or less than another person in the same accident. We work for the maximum compensation available to you with our estimate that includes past, present, and future expenses.
Economic vs. Non-Economic Damages
Economic losses include items such as medical bills and the cost to repair or replace your car. Non-economic losses are the suffering you experience and changes to your life as a result of the crash. Your rear-end collision attorney in Lilburn will help you list the damages you can pursue in your claim.
Victims of rear-end collisions usually seek damages such as:
- Doctor bills
- Crutches, canes, wheelchairs, neck braces, and other medical aids
- Prescription and over-the-counter medications
- Hospital costs for ICU, ER, or surgery care
- Mileage and related travel expenses to receive treatment
- Costs of in-home nursing care or a rehabilitation facility
- Income you lose while you cannot work
- Loss of consortium
- Emotional distress and mental anguish
- Pain and suffering
- Auto repair bills
- Cost of a replacement vehicle
Rear-end collisions frequently cause neck or back injuries that may take days or weeks to appear. Instead of settling quickly, your attorney will advise you to receive a full medical evaluation so you are not left with bills you cannot pay in the future. You may also suffer injuries that leave you unable to work for long periods of time.
An Experienced Lawyer Can Strengthen Your Compensation Claim
After a rear-end collision, you have the right to seek reimbursement from the person who is to blame. If the other driver is charged with following too closely, it may seem easy to prove they were at fault. However, insurance companies will try to reduce and deny your claim if they can, even arguing that you are to blame.
This is where you can rely on the knowledge and experience of the team from John Foy & Associates. We will negotiate with insurance representatives to push back against their underhanded tactics. We will not rest until we reach a fair and appropriate settlement for your needs.
When we cannot get them to agree, your Lilburn rear-end collision attorney will take them to court. Your attorney will build a solid case for your compensation by providing services such as:
- Collect evidence to prove fault against the driver who hit you
- Negotiate aggressively with insurance carriers to secure all your losses
- Work with medical providers to gather pertinent medical records and receipts
- Negotiate potential out-of-court settlements with opposing counsel
- Get your injuries diagnosed by medical specialists in our network of professionals
- Visit you wherever is most convenient for you while you heal – your home, the hospital, or our offices
If there are multiple parties involved, you might be overwhelmed trying to deal with different insurance companies while you try to heal. John Foy will take that burden off your shoulders and do this difficult work for you.

File Your Claim Quickly or Lose the Right to Compensation
When you file an insurance claim or lawsuit, there are specific deadlines you must meet for your case to be successful. Missing timelines because you are in too much pain to understand can cause you to lose the compensation you need. At John Foy & Associates, we know you need help, and we are here for you.
Georgia’s statute of limitations on personal injury lawsuits is only two years from the date of the accident. If you do not file your case before that time, you can lose your right to seek compensation. John Foy understands all the laws regarding filing claims, and we ensure your paperwork and documentation are submitted correctly and on time.
