Common Bicycle Accident Injuries We Handle
Cyclists are extremely vulnerable when sharing the road with cars, trucks, and other large vehicles. Even with a helmet, the impact from a crash can lead to devastating injuries. As bicycle accident attorneys in Columbia, SC, we’ve helped riders recover damages for:
- Broken bones and fractures
- Traumatic brain injuries (TBIs)
- Spinal cord injuries or paralysis
- Facial injuries and dental damage
- Internal bleeding and organ trauma
- Road rash, lacerations, and infection risk
Medical bills after a serious bike accident can add up fast, especially if you need surgery, rehabilitation, or long-term therapy. We help you seek full compensation so you’re not stuck covering those costs out of pocket.
Who is at Fault in a Bicycle Accident?
South Carolina law requires drivers to keep a safe distance from bicycles and give them the same rights as other vehicles on the road. According to South Carolina Code of Laws § 56-5-3435, a motorist must maintain a safe operating distance and may not harass or endanger a bicyclist in any way.
However, drivers often fail to follow these rules, especially when:
- Passing too closely or cutting off a cyclist
- Failing to yield at intersections or crosswalks
- Turning without checking blind spots
- Speeding or driving aggressively in bike lanes
- Texting or driving distracted
If a driver caused your accident through reckless or negligent behavior, they can be held legally and financially responsible. Our job is to prove what happened and fight for every dollar you deserve.
What Types of Compensation Can You Recover?
When we take your case, we look at the full picture — not just your hospital bills, but the total impact the accident has had on your life. You may be eligible to recover:
- Medical expenses: including ER visits, surgeries, physical therapy, and medications
- Lost wages: if you’ve had to miss work during your recovery
- Loss of future income: if your injuries prevent you from returning to the same job
- Pain and suffering: for physical discomfort and emotional trauma
- Property damage: to repair or replace your bicycle and gear
- Punitive damages: in cases involving extremely reckless behavior
If the insurance company tries to offer a low settlement, we’ll push back with a strong case built on evidence, expert testimony, and your personal account of what happened.

Distance is no obstacle. We work with clients across the country and make sure every one of them feels taken care of, no matter how far the call travels.
What if the Driver Doesn’t Have Enough Insurance?
A question we often hear is, “Does car insurance cover bicycle accidents?” The answer depends on the driver’s policy. In most cases, if the driver was at fault, their liability insurance should cover your injuries. If the driver is uninsured or underinsured, your own auto policy may provide coverage through uninsured motorist protection — even though you were on a bike.
Our team can review all available insurance policies to make sure every possible source of compensation is pursued. We won’t leave money on the table, and we won’t let insurers play games with your claim.
Will You Need to Go to Court?
Another concern many clients raise is, “Do you have to go to court for a bicycle accident?” In many cases, no. We can resolve the claim through negotiation. However, if the insurance company refuses to offer a fair settlement, we are fully prepared to take your case to trial.
Our team has decades of litigation experience and will be ready to present your case in front of a judge and jury if that’s what it takes.
Why You Should Call a Bicycle Accident Attorney in Columbia, SC
Insurance adjusters may act friendly, but their goal is to protect the company’s bottom line — not your health or recovery. They may try to blame you, downplay your injuries, or push you to settle fast. That’s where we come in.
When you hire John Foy & Associates, we will:
- Investigate the crash thoroughly and preserve key evidence
- Gather witness statements and police reports
- Work with medical experts to understand your injuries and prognosis
- Negotiate with insurers and handle all communications
- Take the case to trial if a fair resolution cannot be reached
