Macon Highways Can Be Extremely Dangerous
Macon is at the center of two major interstate highways south of Atlanta, including I-16 if you are traveling east to west and I-75 if you are traveling north to south. There are several reasons why highways are more dangerous than roads in the city and busy intersections.
First, highway motorists are often traveling at far greater rates of speed. The faster a vehicle is traveling, the more likely a collision will be catastrophic. The vehicle will absorb the impact of the crash and likely leave drivers and passengers with life-threatening or fatal injuries. If you lost a loved one in a deadly crash, our Macon wrongful death lawyers offer compassionate support.
However, there are also concerns about distracted driving during peak hours of congestion, which can often result in sideswipes, hit-and-runs, and rear-end collisions. But these are not the only causes of accidents on interstates. Our former clients have been involved in highway crashes caused by:
- Defective motor vehicle parts
- Dangerous weather conditions
- Lack of sufficient road maintenance
- Road rage
- Driving under the influence of drugs or alcohol
- Failure to yield or stop
- Making unlawful turns
- Failure to check blind spots
- Failure to use a turn signal
Sometimes, large commercial vehicles cause these accidents. In this situation, a truck accident lawyer in Macon can help.
Proving Liability for Your Damages
Your highway accident lawyer in Macon, GA, will be responsible for determining the cause of your collision. Georgia follows fault laws, so the liable party will be expected to compensate you for your damages accordingly.
The burden of proof in car accident and personal injury claims is based on a preponderance of the evidence. Throughout our investigation, we will be gathering the evidence we need to support your case, which may include:
- Photos of your injuries
- Data from your vehicle’s black box
- Copies of the defendant’s chemical blood alcohol test results
- Video footage of the collision
- Depositions from witnesses to the accident
- Reports from highway accident reconstructionists
- Copies of the defendant’s driving record
- Testimony from law enforcement officials who arrived at the scene
- Crash reports and safety inspection logs
Liable Parties to Sue After a Highway Accident in Macon
Depending on the cause of your highway accident, there may be multiple parties found culpable for your damages. For example, if your collision was caused by a large pothole, we may question whether the Georgia Department of Transportation (GDOT) failed to take action and make necessary highway safety repairs. Our Macon car accident lawyers may pursue claims against applicable road construction workers, government contractors, and other relevant parties.
You may think your case is cut and dry if your accident was caused by a negligent driver. However, even in this case, other parties could share blame. For instance, if you were suddenly struck by a drunk driver and a Macon dram shop was found to have served them alcohol when they were already intoxicated, you may have the right to sue the dram shop and dram shop employees through George’s dram shop liability laws under O.C.G.A. §51-1-40.
These are just a couple of examples of parties that could be sued for your injuries and damages. Your Macon highway accident attorney will work tirelessly to investigate the cause of your crash. That way, we can identify anyone and everyone who may share the blame for your suffering.
Specific Car Accident Laws Could Impact Your Macon Highway Crash Damages
After being involved in a car accident on a highway or interstate, you may be anxious to bring the liable party to justice. As you navigate the claims process, it is important to remember that there are multiple personal injury laws that could influence your ability to maximize your financial compensation and pursue your case.
Insurance Laws in GA
One of the top ways to recover compensation after a highway accident is by filing a claim with the insurance company. Georgia follows fault insurance laws, so you should be prepared to file a claim with the liable party’s insurer as opposed to your own.
Modified Comparative Negligence
The liable party may blame you for causing the accident or contributing to the injuries you sustained. However, Georgia follows a modified comparative negligence system. This allows you to be awarded compensation for your losses despite sharing liability, but only if your portion of the blame is not greater than 50%.
If your portion of liability exceeds this threshold, you will not be entitled to compensation for your damages. If it is less than the bar, you can be awarded compensation for the portion of the accident that was not your fault. This means you can expect your settlement to be reduced proportionately.
