The party liable for a Postmates car accident depends on the facts surrounding the incident. Following your Postmates car accident, meet with a car accident lawyer in Atlanta. Next, your attorney can examine your accident and determine who is at fault.
If you are not liable for your Postmates car accident, hold any at-fault parties accountable for their actions. An attorney can help you file an insurance claim or personal injury lawsuit. They can pursue damages for your accident-related losses.
What Factors Determine Who Is Liable for a Postmates Car Accident?
Negligence plays a key role in determining liability for your accident. For example, a motorist takes their eyes off the road and crashes their vehicle into yours while you are making a Postmates delivery. If this happens, the other driver is negligent, and they may have to cover the losses you incur in your accident.
Alternatively, Postmates, a government entity, and other parties can be liable for a car accident. If you are unsure of who is responsible for your accident, consult with a lawyer. From here, your attorney can identify any at-fault parties and help you request damages accordingly.
The car accident statute of limitations in Georgia is two years. If you want to file a claim against any parties liable for your Postmates car accident, do so right away. Otherwise, you could miss the opportunity to collect damages and have to cover your accident-related losses on your own.
Can I Be Liable for a Postmates Car Accident?
Unfortunately, you can be liable for a Postmates car accident. If you make a mistake behind the wheel or do not follow the rules of the road, you could have to cover the losses of anyone involved in your accident. Thankfully, your insurer or Postmates may help you.
After your accident, notify your insurer and tell the company about your accident. The business will investigate the incident. If the company finds you are at fault, it can cover your losses and those of others involved in the accident.
If you are working for Postmates and get into a car accident, inform the company about the incident. Postmates offers insurance coverage to its drivers. This coverage supplements your auto insurance policy, and it can protect you financially if you are liable for a Postmates car accident.
What Damages Can I Get from Someone Liable for a Postmates Car Accident?
The damages you can collect for a car accident can cover your economic and non-economic losses. An Atlanta car accident lawyer can discuss these damages in detail. Here are reasons why a judge or jury may award damages based on your Postmates car accident.
Medical Bills
In some cases, medical bills from a car accident exceed policy limits. Thus, it may be best to sue a liable party for your medical costs. To do so, work with an Atlanta car accident attorney who will track your medical expenses and help you prove to a judge or jury that you deserve compensation for them.
Car Repairs or Replacement
Your car is out of service due to your accident. Depending on your car damage, it could be weeks or months before your vehicle is repaired, or you may have to replace it. A lawyer will account for your car repair or replacement costs as they calculate your damages.
Lost Income
It becomes difficult to work and earn money if you suffer an injury in your accident. Or, if your accident results in a disability, it can prevent you from working for the rest of your life. An attorney will consider your lost wages, making sure you ask for damages that give you enough money to stay afloat financially.
Loss of Enjoyment
If your Postmates car accident keeps you from enjoying your life the way you did previously, speak with an attorney. At this point, your lawyer can gather medical records and other evidence to show how your accident is impacting your life. Your body of proof may compel a judge or jury to award damages based on your loss of enjoyment.
Pain and Suffering
You experience pain and suffering in the moments after your accident and long after the incident. These issues affect you physically, mentally, and emotionally. A lawyer will learn about your pain and suffering and include them in your damages request.
Even if you have auto insurance, having a lawyer at your side to help you deal with the aftermath of your Postmates car accident can be beneficial. Your lawyer can prepare an argument to show a judge or jury you are not at fault for your accident. They will also protect your rights as you move through the legal process.
