What Makes Drunk Driving Crashes Different
A drunk driving collision is still a car accident case, but alcohol use often changes how liability is viewed. When a driver chooses to get behind the wheel impaired, that decision may support a strong claim for damages when it leads to a wreck.
In many cases, the criminal DUI charge and the civil injury claim move on separate tracks. Even if the criminal case is delayed or reduced, you may still have the right to recover compensation through a personal injury claim.
We often help clients gather evidence that shows intoxication played a role in the crash. That can include police reports, field sobriety results, witness statements, and video footage.
Damages You May Be Able to Recover
Georgia law may allow you to seek payment for both financial losses and personal harm. The amount depends on your injuries, the impact on your daily life, and the evidence available.
You may be able to recover damages for:
- Medical expenses.
- Lost wages and reduced earning ability.
- Pain and suffering.
- Property damage.
- Wrongful death losses.
In some drunk driving cases, punitive damages may also be available. These damages are meant to punish especially dangerous conduct and may apply when a driver’s intoxication shows a reckless disregard for others.
Evidence That Can Strengthen Your Claim in Jasper
Strong evidence can make a major difference in settlement talks or at trial. The sooner evidence is collected, the less chance there is that details will disappear.
Useful evidence often includes:
- The police accident report.
- Photos of the vehicles and scene.
- Medical records and treatment notes.
- Witness names and contact details.
- Surveillance or dash camera footage.
Your Jasper DUI accident lawyer may also review bar receipts, toxicology reports, and prior statements made by the driver. In some cases, accident reconstruction and medical opinion evidence can help connect the crash to your injuries.

Distance is no obstacle. We work with clients across the country and make sure every one of them feels taken care of, no matter how far the call travels.
Who May Be Liable for Your Losses
The drunk driver is often the main party responsible, but other parties may also share liability depending on the facts. Every case should be reviewed closely to see whether additional insurance coverage may be available.
For example, a vehicle owner may be involved if they negligently entrusted the car to an impaired driver. In some situations, a business or other third party may become part of the case if their actions contributed to the harm.
An attorney from our firm can investigate whether more than one defendant should be named. That can matter when your injuries are severe, and the at-fault driver’s policy is not enough to cover the full loss.
How Georgia Law Affects Your Case in Jasper
Georgia follows a modified comparative negligence rule. If you are found partly at fault, your recovery may be reduced by your percentage of responsibility, and you cannot recover damages if you are 50% or more at fault.
That rule can become part of the insurance company’s defense, even in drunk driving cases. For that reason, it helps to build a clear record showing how the impaired driver caused the crash.
There is also a deadline to file most injury lawsuits in Georgia—typically, two years from the date of the accident. If you wait too long, you may lose the chance to pursue compensation, so acting promptly can protect your claim.
How Our Jasper DUI Accident Lawyers Can Help
After a wreck, you may get calls from insurance adjusters before you know the full extent of your injuries. A lawyer from our firm can deal with the insurer, gather records, and build a claim that reflects what the crash has actually cost you.
We work to identify every source of proof and every available policy. That may include the drunk driver’s liability coverage, your uninsured or underinsured motorist coverage, and other facts that affect the value of the case.
A Jasper DUI accident attorney from our firm can also help you avoid common mistakes, such as giving a recorded statement too early or accepting a quick settlement before treatment is complete.
Why Early Legal Action Matters
Drunk driving cases can seem straightforward, but delay can still hurt the claim. Witnesses become harder to reach, video may be erased, and medical gaps can create problems during settlement talks.
Early action gives your legal team more time to secure records, inspect the vehicles, and speak with witnesses while memories are fresh. A lawyer from our team can also coordinate with the criminal case timeline without waiting for it to finish.
When you contact us soon after the crash, we can start preserving the proof needed to present a stronger case. If a drunk driver injured you or someone you love, reach out today to discuss your options and the next step toward financial recovery.
