What to Do After a Rear-End Collision in Fairburn
When you have been struck from behind, you need a dedicated rear-end collision lawyer in Fairburn, GA to take on your case. However, at the scene of the accident, you may be scared and unsure of what to do next. Fortunately, you can take the following steps to start building a powerful case against those responsible for causing your injuries from the start:
Obtain Compelling Evidence
One of the first things you can do to help your rear-end collision lawyer build a case against the at-fault party is to gather as much evidence as you can at the scene of the accident. The evidence at the accident scene is some of the most valuable evidence that can be used to support your case.
In fact, if you are able to obtain statements from witnesses immediately after the accident, this could be the supporting evidence you need to prove liability and negligence in your case. Additionally, nearby businesses, residential properties, and other establishments may have surveillance cameras that catch the collision on camera.
If they did, and you can obtain this video footage with help from your attorney, you may be able to show the court and insurance company exactly how the accident occurred and how the defendant is responsible. Other types of evidence that you may be able to gather after a rear-end collision include:
- Photos of your rear-end collision injuries
- The name of the driver who rear-ended you
- The insurance information of the driver who rear-ended you
- The names and contact information of any witnesses to the accident
- A detailed account of how the accident occurred
- Video footage of the surrounding property damages
Secure a Medical Exam
Rear-end collisions have a reputation for being minor accidents. However, what they do not tell you is that this is partly because many people do not initially feel as though they have suffered debilitating injuries immediately after a rear-end collision.
But this is often due to the shock of the experience. Once your body starts to calm down after the accident, you may realize how severe your injuries truly are. It is not unusual for victims to suffer concussions, whiplash, soft tissue injuries, neck injuries, broken bones, and other critical injuries after an accident.
However, if you do not obtain a medical evaluation, your injuries could become substantially worse if they were made untreated. In obtaining a medical evaluation as soon as possible after the accident, you can also do your case a favor by creating documentation of the severity of your injuries with medical records.
Get a Rear-End Collision Lawyer on Your Side
Once your healthcare providers have stabilized your condition, be sure to contact a rear-end collision attorney in Fairburn, GA to take on your case. Although moving forward with a lawsuit or filing a claim with the insurance company is the last thing you want to be doing, the sooner you take action, the better.
Remember, some types of evidence are only available for a short period of time. If we do not get started on your case before video surveillance is deleted, obtain the minute details from witness statements, and otherwise gather important evidence, your claim against the liable party may lose its strength.
Consider Your Options Following a Fairburn Rear-End Collision
There are multiple ways you could take action after you have been involved in a rear-end collision. Fortunately, your attorney can help you consider your options and seek the compensation you deserve across all appropriate avenues.
When to File an Insurance Claim
Georgia follows fault insurance laws. When you are involved in a rear-end collision, you file a claim with the other driver’s insurance company. However, if you purchased your own insurance no-fault insurance coverage or under or uninsured motorist coverage, and the defendant lacks the coverage you need to cover your costs, you may have the chance to file a claim with your own insurer to recoup certain types and amounts of losses.
When to File a Rear-End Collision Lawsuit
Insurance only covers certain types of damages. Although we would all like to file a claim with the insurance company and have that be that, the truth of the matter is that insurance is designed to cover specific types of economic losses.
Not all of your non-economic damages and economic damages can be recovered through insurance claims. You need a Fairburn rear-end collision attorney on your side who will not be afraid to bring your case to trial if that’s what it takes to maximize your compensation.
